If you make them on U.S soil they could just walk in and shut you down, if they say it's illegal, making it here won't make it any more legal than importing them


Yeeeeess, but there are hundreds of thousands of businesses in the US....the FDA doesn't monitor them all - and shouldn't. I can't see them watching a business that manufactures something, say, related to consumer electronics or novelties.

I'm still curious about JC. They registered with the FDA, (so the FDA knows about them) and nobody's shot any rumors out here about them. I know their hasn't been any drama in Johnson Creek (small town, just down the street from me locally, and my husband works in Creek) - so I'm guessing they're still in business.....

Once other suppliers start complaining that they are not enforcing the law fairly they will call attention to any american company.
 
I believe the import notice is FDA 66-41. Near the top of that list of confiscated items, you will read that personal delivery of a banned product is illegal. It says there is great misunderstanding about this point, but you in fact cannot order one from China or anywhere else if e-cigs are banned. The restriction is not just for large orders, but for all orders of any size.

And it is still a Federal offense to copy a VCR or DVD, and it is still against the law to purchase pharmacuticals online, and now you have to show your I.D. to purchase Actifed (Ephedrine), and it is still against the law to run an escort service....So what is your point exactly?

Personally, I believe the FDA will follow through with what its stance has been all along...Case by case they will investigate. (Like the 250 bottles of e-liquid they grabbed from me in PA US Customs on April 10th with still no decision). Our government has one of the most effective ways of detering people. They grab your stuff when they feel like it, and it is usually when you least expect it.

That is why after Sunday I am hanging up my hat. The costs are too high with the risk. The quality of the devices now coming out of China are pathetic! I have an average of one bad atomizer or battery for every 3 or 4 kits. I may sell e-liquid soon on a new site, but that will have nothing on there to do with FDA regs, as I am just selling flavorings. What you do with them is up to you! All of the ingredients will be FDA approved...and if you should want to use them for another purpose like vaping, well that is up to you...As they can be used for candy and ice cream too! LOL

Yes, Tropical Bob, the regs are what they are. But after growing up with a father that worked civil service with the military, I am pretty confident that this will play out like these things always do. They will smolder out just like a cigarette in an ashtray! Quite the analogy, but true...
 
The FDA needs to get back to monitoring the safety of FOODS and DRUGS. They currently have no jurisdiction over tobacco and they don't have the competence to monitor and police tobacco. They can't even do their job with the FOODS and PHARMACEUTICALS.

Congress needs to point them to these dietary supplements and male enhancement bull$h1T drugs if they have so much extra time on their hands. They can start regulating those. Best of luck to 'em. (Damn bureaucrats.)

Unless they are going to outlaw nicotine and nicotine containing products outright, they're gonna have a hell of a time stopping people from making their own juice for their own use because the cat is out of the bag as far as how to make the juice. They may be able to slow it down but prohibition backfired with alcohol and I don't see big pharma or the tobacco companies sitting still for an all out ban on nicotine products, do you?

And I agree: Good old reverse engineering is not something that is exclusive to the Far East and I believe there is the will to produce these products in various forms here in the US and in Europe. Small changes in design and material get you around patent issues. The Chinese taught us that.

(Whew! Didn't know I was gonna get up on the soapbox...sorry 'bout that. I'm such a bitter old b1TcH! ;))

Ah, but didn't PM help author the Waxman bill? I'm sure when they come out with their device it will be FDA approved, with tamper-proof carts containing FDA approved nicotine manufactured by Big Pharma. All nice and legal. And it will probably sell for $150 and we'll all be ready to pay it after jonesing for a few months with no PV. .......s is too good a name for 'em. :-x

I'm not sure what CaSH is up to. He knows what's about to happen as well as we do. The battery pack and PT would probably be legal if not sold with an atomizer. But he's designing his own atomizer as well. I wonder if you could sell the things with plain PG or VG and call it a novelty item? According to FDA, it's about the marketing of the devices and the nicotine. If they are marketed to be used w/o nicotine, as a novelty item, the FDA might not have any authority to regulate them. We'll have to wait and see. I hope he gets one over on 'em.:thumb:

supposedly PM had a patent on a similar device and they let the patent expire, now this new device will not fall under the new ruling...they used us to do the dirty work and i believe that a representative from PM is on the FDA board of directors or something like that...not sure exactly. too much is happening at once and my brain is seized...but PM is evil!!!
