Fired for Vaping

Today my employment was terminated at the local Clerk of Courts Office for vaping.

In the employer manual there is strict no smoking policy within the confines of the building or 50 feet around it, but as we all know vaping isn't smoking.

She said that it seemed like more of a break time activity, so I put it away.

I don't know of any municipal bldgs. that allow smoking OR vaping inside.
You have worked there for a year, and it has never been brought up? Not once?

When the lady said it seemed like more of a break time activity....Have you been stealth vaping or vaping pretty much out in the open? Whenever and wherever? How long have you been vaping inside a county/city building while on the clock?

Need more information I guess.

My first thought is that a number of people may have thought you were a "slacker" if you were vaping while on the clock, sort of like lunching while not on lunch break or something?

Did you ask why you were not given any kind of warning????????

Not sure now that I look at it, he said both. Is it possible to offend someone with vaping?

how could it offend someone??? god, the amount of people offended by ANYTHING these days.. jesus christ it is really out of hand... man, i am so mad about this firing i cannot see straight.. seriously, someone cannot make a living due to this first infraction? good grief.. the death of common sense again is played out (furiously shaking my head in disgust)

I feel bad for you.

OTOH, working with such a bunch of backstabbing sycophants would have eventually led to the same result based on some other perceived 'offenses' or 'infractions'...

Time to move on. I hope you'll find a place where 'live and let live' is still practised

"Four women huddled together" = Kiss of Death for you. You were doomed as soon as that happened and didn't stand a chance. I'm sorry you lost your job, but hopefully it will turn out for the best. Karma will get that bunch of busy-bodies, it always does. I hate self-righteous people, so full of themselves. Good luck and hopefully the New Year will be the beginning of a new job at a wonderful place full of caring, understanding folks!!

Now Florida is an at-will work state, but he has made it seem like you will not be fired for something unless it is wrong and breaks a rule in the employer manual. I'm still in shock about today, I have only worked there for a year but have never even had a warning.

Employment at xxxxxx would be very different than just a private business in Ocala as far as employment --- employment and dismissal would be outlined in the xxxxxxxxx.

Are you covered by that? Were you a county employee?

Yep, and I just found out that my county is the only county in florida with an ordinance applying smoking rules to vaping.

The magnitude of that ordinance has been heavily publicized in the media....and in hearings....

so were employees not given any kind of memorandum after it was passed? In a xxxxxxx, that would be rather unusual. :blink: Most any xxxxxx, that announcement would also be POSTED publically, on the board where announcements/laws are posted.

Since the public also goes in and out of those offices by the hundreds every day.

So there was no memo, no announcement, and no postings of the banning of ecig use on the xxxxxx premises?

Wonder if any of these women had perfume on them, I find that to me at least as offensive
as any vaping. That stuff and reek up a whole room.

Don't understand this stuff really!

I was sorry to read about your situation. I live in Tennessee, and vaping here is still a controversial issue. It seems to carry some of the same stigmas as smoking, even though it's healthier and doesn't impose the same hazards to those around you. My fiancee and I only started vaping a few months ago, and I've asked her not to vape inside certain places... work being a big one, Walmart another. Her boss doesn't understand what vaping is... she lives with a smoker but does not smoke herself. I understand that some of it is an appearance issue. You have to be professional when you're on the job at all times. I vape on my school bus, but NEVER in the presence of my children. I'm expected to be a role model as much as a driver (read: professional baby sitter). Anyway, I treat vaping like smoking when I'm out in public. I try to avoid doing in within the confines of a building, or around groups of people. I like getting around a group of smokers and vaping in front of them. It gives me an opportunity to tell them about a healthier way of doing things when they ask me about my Itaste battery and tank.
BTW, I've read up a lot on these so-called "Right to work" states. Here in Tennessee we call it the "Right to be Fired" state. They'll fire you just because they don't like the color of your hair, or your shoes, or something like that.
I don't know if this helps you any, but I hope you can find a place that has a better understanding of vaping. Our new way is catching on. Lots of smokers are quitting the tobacco companies and it scares the hell out of the likes of RJ Reynolds. Why do you think the FDA is trying desperately to regulate E-Cigs? Anyway... didn't mean to rant. My point is, as vaping continues to catch on, the companies that support tobacco are gonna get more and more aggressive. We're gonna eventually have to fight for our right to be healthier. Getting fired from a job is just one symptom of the larger problem of misunderstanding and need for control by the government and its lobbyists. I say, vape on! Let the tobacco companies die out as they should. Hell, it may help to solve some of the problem with illegal immigrants as they won't have as many jobs to steal from us bona fide American citizens.
Anyway, just my take on things. Hope you can find better employment soon. Don't let it get you down. It's not your fault. Just work place politics. Happens to the best of us.

I'm very sorry to hear this happened to you, however I am also quite surprised due to the fact that you stated you work at xxxxxxx and were not aware that on xxxxxx passed an ordinance that the use of e-Cigarettes are only allowed to be used in areas where smoking is allowed, so that being said, you did break the Policy set forth by your employer. Again, I am truly sorry to hear you got fired over it and it's shame. xxxxxxxx is the one that rallied for this to be done, despite my efforts and a few others to try to get the Board of Commissioner to not pass this ordinance but was unable to attend the 2nd meeting which was the Public Hearing on this issue, I had sent them a detailed rebuttal about the negative information that xxxxxxx was using to get this ordinance to pass and as no other individuals or groups attended that particular hearing they passed it and made it where you can only vape where smoking is allowed.

It's really aggravating that these people in these positions only have 1 thing in mind and that is only there agenda.

Once again, I am very sorry this had happened to you! This is a prime example why we as vapers need to really band together and try to bring facts into play to stop this people from walking all over us with no shred of logic or facts.

It is listed on the xxxxxxx website that the ordinance had passed and prohibited the use of e-cigarttes in places that cigarette smoking is prohibited. In addition anyone that had contacted the Board of Commissioners in reference to this ordinance was notified by e-mail of the passing of the ordinance which came 3 weeks after it passed. I have it sitting in my saved folder.

Seriously? Would you also be ...... off if he was drinking a cup of coffee at his desk?

I suppose you must be too young to remember when norm for workplaces was that people could smoke anywhere, anytime.
