Need I say more

You had to go there, didn't you?

State is irrelevant; this is about a particular Police Department. Being that the incident took place in a "small suburb outside of Sacramento", it's less likely to be Democrat; we just don't know, but it's not relevant either. I could just as equally say that Republicans are carelessly cutting budgets, but that's not relevant either, right?

This isn't political, at all. I like ECF because of what we all have in common, which transcends politics and religion.

i was pulled by a state trooper a couple weeks ago and he looked at my protank2 on a simple twist style battery for about 25 good long seconds and told me to put it in my seat and didnt say anything else about it

Well, I guess you were lucky then?(not directed at you bmilt) See, this is where I wish I were in that situation and could calmly have a talk with that officer. I think they need to be informed instead of telling us to put it out of sight...like he let you off easy just because he didn't know what it really was? Or maybe he knew what it was, but played the "you better put that in hiding because it may be bad" routine. Tough guy routine is all he did. Nonsense

Research "warrantless search" and "warrantless arrest".

CB,

I did. That has nothing to do with the OPs post!

The OP was stopped for having a PV. If you read my 'aids/advice' without jumping through loops to try to prove your unfounded point, we could have been in agreement several posts ago. I gave a couple of solid, rational, proven and logical means to minimize a citizen's heartburn.

I guarantee/promise you and the rest of the ECF, that I will not be detained voluntarily under such RS or PC for having a PV. If I ever get bagged and suffer 'their' consequences, I'll use my lawyers advi$e and let ya'll know where I screwed up.

Most LEOs I've met would not have an issue with my refusal to a search. As I posted earlier, I'd respectfully request to speak with their shift supervisor. Have done that thrice with two immediate dismissals and one supervisor visit, concluding with a congenial dismissal and a "Thank you, sir."

The advice I gave is solid and within the law, assuming no one has broken a law. Once you and all the other innocents understand our standings within the law, the less you need to fear it!

What I've posted applies to 99+% of our folk here. Pick on da 1% bones if ya wish and enjoy yourself! <click>

I commend you for taking the time to explain e-cigs. It's unfortunate that your 2nd encounter was such a disaster.

This is an issue of lack of awareness. A properly trained officer would know the difference; it seems like your local PD is only picking up this info on-the-job. What a waste of resources.

Ummmm you know maybe we should take the lead in our communities.
Informing our local PD's
The can't do it all by themselves....:)

all add 1 more thing. it is never in your favor to be rude or resist an officers direct instuction.
you may be the rap but you wont beat the ride. be polite, be respectfull. neither of the two things require you to give up your rights. there is no need to awnser question such "were do you work", "were did you just come from" or "were are you going".
they all seem like simple questions, they really are not.

Everyone gets exactly what they give me regardless of who or what they are. That badge doesn't earn one ounce of respect. Treat me with respect and it gets returned. Treat me like I am powerless and I will assert every inch of my civil rights. Yes, I may take a ride in the back, but in the end I WILL win and I WILL cause so much s%^& for that LEO they will not soon forget. Been there, done that...

Often when I am out in public, I bring along my smoktek Pipe Mod. At first I thouhgt it looked cool and was very distinguished looking.

Then my friends ruined my fun and started saying it looks like a pipe that you do not smoke tobacco out of... :-/

I still use the Pipe Mod because it is really tiny to put in my pocket, but I am always very worried that people will misunderstand what I am doing.

I know that if a cop pulled up on my mid vape.. he'd see some dude put some odd contraption to his mouth, vape some big cloud of something and me with a content look on his face. Wouldn't surprise me if I got pulled over. Though, if he was a .... about it, that's a different story.

Heh.. just realized that... after smoking for 20 years, I never once really puffed on a cig and thought "Man... that tastes AWESOME" Why I did that, for so long... confounds me now.

I just want to add my recent experience to this, because I thought it was pretty awesome. It happened while traveling, in Phoenix, AZ. I got pulled over. I had failed to signal while exiting the freeway. The police officer took a few seconds to tell me this, and why it was important (very dangerous to motorcyclists apparently.) Then he asked me about what I was "smoking" while driving. My heart started beating faster, I was thinking about how to explain the cloud of vapor with my windows rolled up... I just picked up my eRoll (the actual unit was laying on my passenger seat, not in the case) and told him it was this and tried to hand it to him. He sort of stepped back and then said "Can I see you use it, please?" So I vaped for a bit. And then he was like "My wife's a smoker and I really want her to stop, will this help her?" And then we had a long conversation about vaping and how it helped me and how it might help his wife, and I wrote down some website addresses for him and I guess he forgot about the not signalling thing, because he just said "Thank you" and walked back to his patrol car and drove away.

I live in a very small town. The ONE time I took my vamo out of the house I got pulled over. Now realize we pretty much either know all our cops or know who they are kin to so that might have been part of why it went so well. He asked me what it was. I explained. He asked if he could test the juice. I took it apart so he could do that. He sent me on my way with a "Sorry to be a pain about it but I never seen one like that. Good luck quitting the cancer sticks." It was all very polite and only minimally embarrassing (the blue hair gossip squad had me getting pulled over all over town before I made it home).

In any case I only go out with a cigalike or one of my ego-cs now. I just don't often have the half an hour that traffic stop took to spare. My convenience not theirs.

I have offered to bring my PV collection in and give the officer assigned to the school my hubby works at a quick lesson in the many varietys of ecigs.

Sucks that the PO didn't know what it was, but to be fair, some people are using devices that look like the APVs we use, for other things - so in my eyes, it's understandable why we vapers are getting pulled over.
...

Now, this is what I don't understand: We all know regular cigarettes/tobacco leaves can be used to smoke 'other things', especially if you roll your own cigarettes... has anyone in here, back in the time they smoked, ever been pulled over just because they were smoking a cigarette?

I mean, it is not like the e-cig is something that came out just last week right from Frankeistein's lab, is it? By this time, I would expect authorities to be aware of what an e-cig is!... maybe it looks alike those 'other APVs'... but still, that's not an excuse to pull someone over for that reason only... this 'probable cause' thing is being used too many times to conceal pure and simple ignorance.

If a LEO sees someone driving erratically, a breathalyzer test is adequate. And then, the driver may, or may not be, drunk. To make that test only because you saw the driver drinking something that might be water, and then again might be pure vodka, is clearly uncalled for. Just my 2 cents.
