To my knowledge, all local governments (like the federal and all state governments) have legislative sessions (usually one or two calendar years), at the end of which all legislative proposals that aren't enacted automatically die (and must be reintroduced in the next legislative session).

If anyone knows when the legislative session of the Indy/Merion County Council expires (e.g. the end of 2009, or the end of 2010), please post.

I couldn't find it in the City/County Code (which is where it should be) at

It appears that the Indy Council has defeated the proposed ban on smoking (and e-cigarette usage) in workplaces (as sending a bill back to committee is a common way to kill legislation). According to yesterday's Indy Star article

the committe might reconsider the proposal in the spring of 2010 (likely with some changes to get the votes needed for passage).

This provides more opportunities to encourage Indy Council members (particularly the bill's sponsors and Community Affairs Committee Community Affairs
to remove/exclude the e-cigarette clause (that would ban e-cigarette usage in all workplace) from the smokefree workplace legislation.

This also provides more opportunities to discourage anti-tobacco/nicotine extremists from advocating the inclusion of e-cigarette usage bans in smokefree workplace legislation.

Unfortunately, there still hasn't been any news stories (or council discussion) about the e-cigarette clause that was included in this smokefree workplace bill.

Folks in Indianopolis/Marion County are urged to contact Ms. Kennedy to find out if she intends to also ban e-cigarette usage, as an e-cigarette usage ban was included in the most recently proposed smoking ban for Indianapolis/Marion County, and because now (before the election) is the best time to get her on record regarding e-cigarettes.

Just one week after CTFK and ANR endorsed Melina Kennedy lost the Indy mayoral race to incumbent Greg Ballard, Smokefree Indy has again urged Mayor Ballard and city council to enact a workplace smoking ban (which included an e-cig usage ban when it was last proposed two years ago).

I'd be surprised if the mayor wants to appease those who recently criticized him and endorsed his opponent.

It looks like this is going to be a short, narrow window to approval. Someone from the area should get a copy of the proposed ordinance yo find out what's included.

I spoke to one of the reporters that covered the story two days ago. His article mentioned that the ordinance wasn't available. I mentioned the e-cig issue, and explained how they're often 'folded' into smoking ban extensions without legislators bothering to say so in their media releases.

He said he'd keep an eye on it.

I wasn't aware that Dems won control of the Indy/Marion Co. council till today, but Republicans Vaughn, McQuillen and Ballard's quick response to Smokefree Indy's request for enactment of a smokefree law (before the Super Bowl) was a stroke of genius, and provides us with a much better opportunity to keep e-cigs out of the forthcoming ordinance (than will be the case in January when Dems take over council).

We need to quickly generate letters and calls to Indy/Marion County Council members (especially President Ryan Vaughn, Majority Leader Michael McQuillen and Indy Mayor Greg Ballard) encouraging them to not include an e-cigarette usage ban in their smokefree workplace ordinance.

Below is the e-mail I sent to council members two years ago, and contact info for council members (at that time). It would be helpful is someone checks the council's website and updates my list (as several council members from two years ago may not be on the current council). We also need contact info for Indy Mayor Ballard, which should be at his website. I suggest that CASAA also post a Call To Action ASAP.

Subject: Support smokefree workplace bill, but remove nicotine inhaler ban

Council members,

While scientific evidence has consistently found that indoor tobacco smoke pollution harms workers' and public health, there is no evidence that noncombustible nicotine inhalers (commonly called e-cigarettes) have ever harmed any user, let alone any nonuser. As such, there is no logical reason for banning the use of nicotine inhalers in all workplaces in Marion County/Indianapolis, as the proposed smokefree workplace legislation would do.

As one who has educated the public about the health risks of different tobacco products and has advocated smokefree workplace policies/laws since 1986, I strongly urge you to remove the clause in the proposed smokefree workplace legislation that inaccurately defines smoking as including the use of e-cigarettes, and to support the remainder of the smokefree workplace legislation.

The combustion (burning) of tobacco emits about 10,000 chemicals, while levels of particulates (pollutants) in tobacco smoke indoors greatly exceeds EPA's National Ambient Air Quality Standards (NAAQS) for outdoor air. In sharp contrast, although e-cigarettes emit similar levels of nicotine to users (but none to nonusers) as smokeless tobacco products, nicotine gums, lozenges and patches, they emit NO HARMFUL SMOKE.

Although banning smoking in indoor workplaces clearly protects public health and is long overdue, banning the use of noncombustible nicotine inhalers in workplaces only harasses their users, who have recently quit smoking by switching to e-cigarettes.

Including an e-cigarette ban in smokefree workplace legislation would also trivialize the very real health risks posed by tobacco smoke pollution, and would inaccurately confuse the public to believe that nicotine poses risks to nonusers (when its the smoke).

Once again, please eliminate e-cigarettes from the definition of "smoking" in the proposed smokefree workplace legislation, and then please support the smokefree bill. Thank you for you consideration.

Even more good news is that according to Close enough on smoking ban | The Indianapolis Star | indystar.com

Democrat Angela Mansfield and Republican Ben Hunter, leaders of the effort to close virtually all loopholes in the existing ordinance, have extended their bipartisan cooperation still further by agreeing to Republican Council President Ryan Vaughn's plan.

If the most prominant anti-smoking Democrat on Council endorsed Vaughn's bill, it is almost certain to be supported by most/all other Democrats on Council. And since the Republican Council President is sponsoring the bill, most Republicans on Council should vote for it too.

I don't usually make predictions, but I predict enactment.
