For those that think it can't happen in the US, it's called legislation by regulation.

Roughly how it works is... a governemnt agency writes a new regulation and starts to enforce it. It is usually at the direction of the whoever is in power. Typically used when they can't get legislation through both houses of Congress quickly or not at all. Normally they are written with loopholes to favor certain groups. Those groups may be large contributors, friends or influential lobbyists supporting other organizations that contribute. Sometimes the new rules are even largely written but those groups. If we the people are lucky they post it for comments before implementation. Sometimes they even listen.

Once the regulation is established and enforced, it takes lawsuits to get it over turned. Years can go by before anything is changed. If the regulatory agency wins in court, it becomes the law of the land. If they lose, they can just start the cycle again.

It is also why citizens groups like CASAA are so important.

The president of the US is not even in the FDA's (one of several agencies)
chain of command. The FDA reports to NO ONE.

One can say the Federal Court can tell the FDA to knock it off ...
and often the FDA just ignores them. So...the Federal Court is
reduced to begging.

The Congress can cut off funding to punish them...
But they won't because they have been bought and paid for.

So ... Yes, its possible for the FDA to do what they wish with e-cigs.
Saving grace is ... They waited too long and just read there are now
7-10 Million vapers in the US.

Ya can't vote people in Federal Agencies out of office.
They are appointed and not elected. They report to no one.
So regardless of who is the president of the US ... The agencies Rule!

You are wrong. Well at least mislead. Although it is true that technically the President isn't in the "chain of command" it is not true that that they answer to no one. The President appoints the Commissioner of the FDA and thus he serves at the pleasure of the president. If the President can decide what issues are top priorities for any executive bureaucracy.

It is true that the FDA, just like any bureaucracy, has proxy legislative, judicial and executive powers the still answer to all three branches of government. In the example of the FDA, the president has a lot of power over what issues they will focus on (granted that doesn't mean they wont do other things as well), the congress has power to defund or even disband, and the courts have the power to overturn regulation.

Also, any proposed new rule (ie remember when the FDA banned flavored analog cigs) must be published in the Federal Register and allow time for public comments before they can start to enforcing the new regulation.

I do agree that bureaucracies have to much power and it is way to easy for them to decide what regulations they want subject the American populations to, but I think your comments are little mislead.

I am ready and not worried if the ban comes. I have mechanical mods that take AW batteries. I have rebuildable atomizers. I now that I can handle just vaping juice made from ground coffee. All I would need to buy is batteries, mesh, silica/cotton, kanthal, and PG. Even if they ban e cigs and nic juice, the items I would need would still be available.

I know electronics enough, and I am sure I'm not even close to the mastery level of others, that we could handle the hardware side of things no problem. As far as ejuice, there will always be a grey area to operate in and around. There might be more wink-wink nudge-nudge to it if nicotine juice is "demonized", but no way would I ever, EVER go back to smoking.

Also, don't politicize it. At least in the US, both "sides" are at fault for being inept. I'm speaking as a registered (I) fwiw.

Well you can make stuff yourself. If you need the nicotine, you can always extract it from normal cigarettes/tobacco. THe mass produced items they can ban. But all the mods and rebuildables they really can't. Stockpile ... well I have spare batteries enough kanthal and still around 500m cotton wick left, so I am good for quite a while. PG you can always buy. The only real problem is the nicotine if you want it ... Flavors well, they could ban flavorings of any kind. But chances of that happening are nil, since they can be used for other stuff also

So if you mind fiddling with things, they can not hurt you :)

e cigs can be bought in most stores now including gas stations convinces stores drug stores Walmart and BJ's at this point i don't think they will be banned this argument has been around for a long time at the most juices will be lost and mods .... at this point most folks can just make their own

Don't be so sure Sun Vaporer, they were banned in Australia overnight without a word of warning.

To answer the question, yes, I'm in the process of stockpiling right now.

and watch dirty black market nicotine containing eliquids flood the market that people either smuggle in and cut with third rate PG/VG, or brew up in their kitchen.... and the resultant danger that itself poses....

Prohibition does not solve problems, it only creates more....

This is why there is always some new 'legal high' being rolled out like clockwork. They discover a substance which may have recreational potential, and since there is no law banning it, it is pushed out, people make tons quickly, then it gets banned. Also prohibition removes any sort of safety regulation that does/could exist, and also only costs money to enforce, when they could have just taxed/regulated it and made some money in the end...

This sort of stuff happens whenever some 'arm-chair quarterback' (US term... I know you aussies like rugby, but I am clueless about it except when the ref does that thing when a team scores...) is given authority, and they start exercising said authority on topics they know nothing about. Heck the same thing happened in australia with guns, and gun related violent crime went up.

I'd probably just buy a provari and a real nice RBA. They can't stop me from buying batteries, SS mesh, PG, VG, and flavorings. The only thing that might be an issue is nic, but I'm sure I'll be able to find it somewhere. I'm already under the belief that the government can **** off, so what's the difference?

I think regulation and taxation is much more plausible than an outright ban. If there was a honest government concern about public health cigarettes would have been banned decades ago, but there's too much corporate money to be made.

Either way, I try to keep a 6 month supply of nic base on ice and only use rebuildables.

IF the FDA decides to play its childish control ego protect BP games ...
I'm OK ... I have a 6 month window to find the "work around".

I really wouldn't need 6 months ...
I would just log on to the ECF for the "work around"

If a work around were out there, You would definately hear about it here. Last December I bought 1000 ml's of 48mg pg based nic for the wife and I, and I figure I've got about 6 months worth left, so about June or July I'll be buying another 1000ml's. I've also made the move to quality higher priced PV's that should last years, and I have a couple of RBA's to play with so I'll be adept at rebuilding those instead of relying on cartos.
