New york sales ban next steps

Section 2 of the bill (starting at line 37) purports to ban all sales of e-cigarettes in New York (unless and until approved by the FDA as a cessation product), while Section 1 only bans sales to minors.

But they're a tobacco product, not a pharma product. This wording means they will never be approved... what a tricky witch!

drug-device. I agree that there is no need for legislative action on
this matter. New York has many more important issues, including state
budget cuts and a property tax cap, which are my legislative priority.

There is already far too much government interference in our daily
lives. I am committed to ensuring that every citizen has the right to
make their own decisions without unnecessary government regulation.
This proposal is a complete overreach of government and needs to be stopped.

"For everyone, we are going to be working on trying to get the Senate Health Committee to hold a public hearing on their version of this bill - S695-2011. Here is the bill on the Senate Website. Whether to hold a public hearing is at their discretion, so that's why we have to work on them to do so. If one is scheduled, it will be critical to mobilize as large a gathering of people to attend as possible, whether you plan to actually speak at it or not. Such an event is really where we have to show our strength in numbers."

As for your above statement, somebody should plan a vapers meetup similar to the ones already taking place all over the country near the same place and time of this hearing if we are fortunate enough to get one scheduled.

Sassy, please encourage Mr. McLaughlin to offer an amendment to the bill when it comes to the Assembly to strike Section 2, thus only banning the sale of e-cigarettes to children. It's very important that this amendment by offered in the Assembly, particularly by a Republican, as even though it's likely to be defeated in the Assembly, Republicans who control the Senate are very likely to bring it up again when it comes to their desks.

I found contact info and e-mailed 9 of her 20 largest donors, telling them about the e-cigarette, why a ban would disastrous to public health, and encouraging them to tell Assemblywoman Rosenthal to only ban e-cigarettes for minors. When I e-mailed the lawyers I made sure to point out the impact that the bill would have on NY-based businesses in this growth industry, and how NY-lawyers will be deprived of the opportunity to counsel and negotiate with the FDA if and when the FDA starts a 1-3 year process of setting up regulations.

LOL John. But, that page is outdated - fortunately for our issue, McLaughlin got elected last November, and he is now a first termer on the NY Assemby.

His campaign chest is still open, you can send money, believe me, if enough money hit his campaign account Albany will do an about face, maybe they'll even start vaping on the Senate floor :)

Remember, the first job of an elected official is to get re-elected, the need for money is always there.
