Indiana's already went into effect July 15, I believe...

There is 1 year wait for the full hammer to drop. Right now its just seals on caps for the most part. Vendors also have a closed time frame to obtain a license to sell or you are SOL going forward. So if you ever want to ship ejuice here you have to pay now or write off selling shipping here for good. This seems to "take care" of the local established shops but.....if a big vendor appears later they are also SOL.

This paves the way for the Indiana Vapor company which is owned by the Casinos and bedded by state regulation to get a semi monopoly framed up. They have thought this through very well.

The bill is slick. Cronyism at its finest.

Would this stop an entity in another state from buying the product then having it shipped to an Arkansas address?

If that is a B2C sale, or C2C sale, yes, technically it would.

Although as has been pointed out, friends sending each other stuff would be hard to enforce, unless they (vastly) increased inspector jobs at USPS, UPS, Fed Ex, etc.

Best thing to do is to ask that those vendors with ejuices you like to obtain an Arkansas' Manufacturer Vapor Product and Alternative Nicotine Product Permit which will enable them to ship and sell products to AR B&M locations where you are.

That is what Vapor Shark did, so here's a shout out to them for *keeping up with things* that are going on in their industry. ;) Vapers who have been vaping for a few years already know that certain vendors manage to establish themselves as the truly alert and responsible ones and that really helps individual vapers IMHO.

Steve, in answer to your question, I know this won't come as a huge surprise (to you anyway), but there are quite a number of vendors out there who are somewhat less aware of this new bill than even some vapers. (I read around). I think it will take a bit of time for it to settle.

Wow, this topic was up 1 whole day before it dropped off the face of the earth.

By the way, it looks like we are being deserted. read my post here:
Indiana HB 1432 signed into law and takes effect July 1st, 2015 | Page 13 | E-Cigarette Forum

Basically, all those vendors who keep saying they have a huge commitment to vapers suddenly disappear on IN and AR vapers when they are in need. So much real activism I can hardly stand it. Turns out to be a lot of lip service if ya ask me.

I am really sorry I ever sent one dime out of my checking account in AR to an out of state vendor, when I could have been buying from an AR B&M. I suggest other people start thinking about that.........because believe me, your state is next. Don't think it isn't.

taxes don't bother me. Bans do. Everyone was telling me the FDA was the boogie man. Turns out it was 2 Republicans in my state who wrote this bill.......and the homeland security governor who signed it.

People still have not come to the realization The FDA is shadier than understood. They already Lost once so rather than try again they have caused enough up-evil through miss-information as to have every sector of government concerned action must be taken.
Then there is the highest likelihood of Back Room meetings to discuss the reality of financial loss to every state as well as the Federal reserve if vaping is allowed to grow unregulated while reducing Tobacco purchases.
These little things are all it takes to motivate a less than FOR THE PEOPLE government to take action to cover their potential losses.

People will not reject these actions because they reach out the same as Tobacco Taxation - A sin tax of the smaller(minority) group of people which use Vaping as means to quit smoking.

People want the Roads paved.
They Want the schools built.
They want more and better Law enforcement.
They do not want to pay extra taxes to get any of it.
That is our responsibility.:(

Id have to meet the new candidate.
I cant make blind ASSumtions, or generalizations without educating myself properly. That would make me an idiot, and that I am not.;)
You will not "meet" the new candidate. You will hear his/her rhetoric song and dance which will change as soon as he/she is elected.

Actually all we want is for them to stop treating us taxpayers like an endless stream of revenue. To be responsible and not bankrupt the state with scheme after scheme on how siphon as much money into their pockets as possible. And while I'm at, how about stop letting the special interest of the day make policy.

Not just sin tax......people will be willing to accept any new taxes, as long as those new taxes are not on them. They'll say, "Oh, I'm not rich, so yeah let's raise the taxes on the rich." This is why in 2014, a record number of millionaires left the US and gave up US citizenship. What's notable is that there are a significant number of individuals on the list that are supporters of the Democratic party.

Record 3,415 Americans give up citizenship

Oh, my heart bleeds for the rich people. It's one thing to complain about the gov't taking your money... it's quite another to complain about it when you've got 10 or 100 million in some tax-shelter. Those tax shelters are the problem! I guess they're afraid they won't be able to feed their children... caviar and champagne. That "Papa John" guy is a perfect example of what's wrong with rich people... he's worth about 400 million... and didn't want to give his employees health insurance. Can't you hear that tiny violin? :sneaky:

Received this today from Vapor Shark
Wonder if this affects businesses selling from Arkansas, and also to consumers having product sent into Arkansas.
Not good..........

Online Retail Sales Prohibited in Arkansas Effective Today
Arkansas ACT 1235 (SB978)

Arkansas ACT 1235 (SB978) is officially in full effect as of today, July 21, 2015. The bill classifies vapor products as tobacco products thereby inherently prohibits any online retail or direct online B2C sales of any "vapor product, alternative nicotine product or e-liquid product" to occur within the Arkansas state line. In addition to disallowing online retail sales relating to any vaping product, all brick & mortar retail locations within Arkansas must now obtain licenses in order to sell vaping products within the state.
See details about the bill here.

Vapor Shark has obtained Arkansas' Manufacturer Vapor Product and Alternative Nicotine Product Permit in order to continue selling and shipping products to all Arkansas brick & mortar locations on a wholesale B2B basis. Vapor Shark's entire product catalog is currently available to our approved wholesale customers within Arkansas. To find a wholesale partner's brick & mortar retail location near you, please click here and choose "Wholesale" under the locations tab.

The effect of Arkansas ACT 1235 (SB978) is not something to be taken lightly. Make your voice heard! The vaping community will continue to face similar legislation across multiple states and your support, input and participation is essential to this industry's stabilization and continuity. While this Arkansas legislation may be a big blow to many online businesses and consumers that choose to purchase their products from any web-based store, we will continue to fight the good fight and do our absolute best to truck forward in the maturation and growth of our industry, and we humbly ask that you help us by communicating with your state officials, senators and congress men and women!

There are many organizations that are dedicated to keeping our industry on the forefront of legislation similar to this. CASAA, or "The Consumer Advocates for Smoke-free Alternatives Association" is a great way for consumers to get involved and make a difference. SFATA, or the "Smoke Free Alternative Trade Association" is imperative to all retailers and manufacturers to be associated with. We are at a crucial turning point in our industry's history and it is important that every person gives back what was so freely given to them in this life-changing industry.

Thank You,

Vapor Shark

I blame Hillary or Bill
