Not much to report. A status report in TW v. FDA saying that TW has submitted documents, and a status report will be filed on or before 4/27 . . . parties still hoping to reach an agreement without further litigation.

And, as always, everybody is welcome. :)

the federal government is planning a shutdown tomorrow because they haven't come up with a budget plan. I heard the federal courts won't hear as many cases. I'm wondering if this case is going to be delayed because of it.

Only if the courts stay shut down past the deadline for FDA to file with the Supreme Court (April 28). If they close for a day or two, it's no excuse for an extension of the filing date, as I doubt whether the DOJ attorneys will be furloughed.

Monday filing in njoy v. FDA (District Court) attached . . . it's Smoke Anywhere's response to FDA and njoy's opposition to SA intervening as a plaintiff.

They're holding the FDA's feet to the fire. If FDA wants to ward off their suit, the Agency will have to make a public declaration that they will no longer attempt to regulate e-cigarettes as drugs providing that no medical claims are made. I believe that FDA will have to file formal settlement agreements with the court for the njoy and Totally Wicked cases if they want to avoid additional suits.
