    I find it ironic that your signature states that you support freedom. Yet you call moronic SE's decision to market a perfectly legal product.

    It's not that they are marketing this product, but HOW. Smoking cessation, healthier alternative....that's what got them in trouble w/ the FDA in the first place. :confused:

    And here is where the real problem lies. It seems that the FDA is operating within the law, but if this is in fact the law, then "the law is a ...". Isn't anyone else blown away by the fact that a company cannot make the claim that this is used for smoking cessation and/or is a healthier alternative to smoking even though it IS true without running afoul of "the law"? Does anyone else realize how utterly absurd this is? This company isn't the problem. The LAW is the problem. The FDA has too much power because "the law" has given them too much power. This lawsuit is nothing more than a symptom of the real problem: the law.

    There isn't a company OR a human being around that hasn't broken numerous laws. You can't blink in this country without breaking a law, and that's a pretty sad state of affairs. They constantly create new laws on top of old laws because they're going to nail you wherever they can. They can turn every law-abiding citizen into a criminal with ONE stroke of the pen. They do it every day. And THAT is the real problem.

    I do support freedom, but that has nothing to do with a company being smart. The ad they are running is just so "not smart".

    JLeigh--They can make all the claims they like---all they have to do is back them up with studies. The days of snake oil salesman is over. And there is a remedy if one does not like the law-----go see your congressperson. It is and always has been the remedy here in the US.

    Sun, with all due respect, I beg to differ. If changing the law was as easy as "seeing your congressperson", things would be a whole lot different in this country. Heck, I'd be on the phone with mine 4 hours a day. ;)

    Nor does this have anything to do with "snake oil". This has to do with the government overstepping its boundaries. It has too much power. This lawsuit is just a symptom of a much bigger problem. "Personal responsibility" has given way to "government responsibility". That just doesn't work for me.

    Why should they be burdened with providing scientific studies? Why can't they quote the testimony of thousands of satisfied customers? If you're accusing them of lying it should be up to you to prove it. Until then you have to assume that the statements they make are truthful.

    This isn't how it has ever worked. BP has to do all the testing and submit it to the FDA for approval. Previously, we had snake oil salesmen at the county fair selling potions which were ineffective and often time dangerous.

    No, no they do not. That is the case when you are introducing a NEW drug in the marketplace. The FDA may have you convinced that this device is a drug that needs approval, but that is not true.
    Any and all activist energies should be focused in not letting the government take control of yet another product/activity.

    Often does not equate to always. I'm pretty sure there was snake oil that turned out to be useful. The free market is pretty good at weeding out the crap.
