Certainly some lawyers are working on a request to delay the ban. They have some time so they should take it to perfect their argument. May be they need to persuade a judge that the governor exceeded his authority. So how did he do that exactly? They need to do a good job. A lot of family businesses are at stake.

1) A High Likelihood that a whatever you are asking the Judge to Issue the Injunction for will be Ruled for in a Court.
2) A Issue is Very Time Sensitive.

I imagine that the Main Argument will be Not be that Cuomo doesn't have the Authority to issue a Ban in a State of a Public Health Emergency. But that the New York Health Department did Not have an Adequate Reason to Declare a Health Emergency.

And that there is No Published Study Data that a Ban will have a Significant Positive Outcome to justify essentially Shutting Down an Entire Market Segment.

Make No Mistake about it. Both Gretchen and Cuomo knows Full Well that an Injunction will be sought.

And since the Decision to move forward with a Ban, both respective State Attorney Generals have the Legal Machine cranked up to Counter it when it comes.

And if/when the Injunction is Successful, It is also a case of Seeing if they can get a Favorable Court to Rule in their Favor.

Or, what is Sometimes referred to as... "Throw it at the Wall and see if it Sticks".

Is anyone working on making vaping a religion yet? We could even get tax free status.

I am actually deadly serious about this.

Some dude claimed to be part of the Flying Spaghetti monster religion and wore a colander on his head as "religious head gear." He won.

I think we need to make vaping a religion. I am pretty serious about this. There are many, many things that could be written to cause Vaping to meet the tenets of a religion and the USA doesn't know what to do with religions because they are a bunch of puritans.

You know, we could have "religious vape store" much like stores that sell bibles and other Christian based stuff. Religious based holidays. Certainly all the religious paraphernalia that we want, including our hand held miters of incense.

And we all know a good religious person should worship at home.

This is either a stroke of genius or total insanity I'm not SURE. But I can certainly write some religious based poetry and the like, we could get @Baditude or @Mooch or whomever do the Ten Commandments of Batteries. There is SO MUCH that could be done.

I really think if they are going to get like that at US we may need to fight back with a smidge of untouchable zany.

I think we need to make vaping a religion. I am pretty serious about this. There are many, many things that could be written to cause Vaping to meet the tenets of a religion and the USA doesn't know what to do with religions because they are a bunch of puritans.

Yeah, I was kinda thinking; "OMG,, they're not going to make me stuff the kid back up there in some sort of like, rehymenating strategy, are they? I mean he's BIG, he can pick me up!!!"

Of course, for the cause of vaping, I might consider it. I have a hunch he might strenuously object, flee the country, change his name you know, whatever.

Can't say as how I'd blame him exactly.

Grr. I am getting ready to go to bed and I was like, "the blessed sound of silence." Then, I heard it because I was listening for it, "CHIRP." It's the last fire alarm I can't find ANYWHERE.

Does anyone know how long this can go on. Weeks? Months? Because I am UNHAPPY about it.

Oh well maybe tomorrow I will try again. Or, alternately, set the house on fire. That would kill the battery right quick..

I had this happen to me with the fire alarm. I had thrown the old one in the garbage, and didn't remove the battery! It was chirping from the trash bin. Took me HOURS to figure that out.

I am an independent contractor, I use Obamacare, it's 30,000$ a year for 2 people, paid out of pocket, no tax payer donation (you have to be really not well enough to get any tax benefit). It's an exchange, and one day if you are sick and don't work for an employer, but work for yourself, you can find bidders for a plan that is still not cheap, but won't leave you bankrupt. Too many people know nothing about Obamacare but hate it because they heard some vague story. Yes it changed health care but since when is change bad? If hospitals start turning people with no insurance away entirely (go die!, too bad) that might cement the issue.

As for McCain, yea, well if serving your country under the most terrifying circumstances, while your plane is shot down serving your country, breaking both legs and an arm when ejecting is offensive, because that is what an ejection is, brutal, I don't know what to say. Landing in a body of water next with broken legs, almost drowning too, getting captured, unlike Rambo on TV and then refusing to leave the POW camp until your brothers are released too, while being tortured for 2 more years, is somehow offensive now to american patriots, but staying at home to take care of your feet that hurt is smarter... The new republican party does indeed leave me reeling.

Just curious where you live (I know this is way off topic all). I looked for a plan for 2 people in NYS and even with a Platinum, top to bottom coverage with dental, the most expensive one I found was $2,200 a month. Still $26,000, but again, the highest rated benefit plan available. $30,000 is a huge amount unless it's also a Platinum "we cover everything including your shoes shined while waiting for the doctor" type of plan. In NY Gold plans can be found for well under that amount. Still a lot of money to pay.

Then again, 20 years ago I had an individual policy under a PPO with out of network benefits that cost me $1,200 a month back then, and only covered me.

Who are the lawyers working for? Right now I'm unaware of any NYS business that's ponied up the cost of a motion of TRO in either state or federal court. The retainer alone would be at least mid-5 figures (very conservative estimate) and judging from what it's costing in just shutting down operations and breaking leases and whatnot, I'm not sure who there even is to mount a legal challenge on a state level at this point.
