Can anyone tell me if this is legitimate or should I fight this? Im a little ticked off by this and I was hoping maybe somebody here could provide some useful knowledge as to what I can do about this. Apparently she used the term "enviromental" danger.

I know that to not be true, and I wish they could have done a little research before deciding that this was something that would be a problem , being that I have had no issues until now at this company.

Thanks in advance,
Brian-

Brian,
I believe they are well within their rights and you don't have a leg to stand on really.

There are no conclusive tests to prove the second hand vape doesn't cause damage to bystanders.

I would most likely quit or look for another job.

Sorry to be the bearer of bad news, but I don't think you have a case.

i was told i cant use the the ecig except for break times and outside , it is treated as the non-smoking policy, and it was stated the company' has its own rules for employees that work for them' even if the ecig was an fda aproved, the company still has the right to not let you use it at work,... and someone plrobably complained about the use of ecig at work, . You can still make an effort to educate the company on the ecig and get other co-workers to jump on the banwagon to request the company change policies, it wont hurt to try..

The NEW saying is "Don't vape where you can't smoke." Really that must suck...Hey I work in the automotive repair industry and constantly weld and cut metal with torches and other industrial machinery. I mean Dude there are sparks flying and it can get smokey as Hades in there...but....NO SMOKING!!! NO VAPING... I just laugh and say "Fire me then." I don't smoke anymore but that was my reply when I did.

My boss is wonderful and I love her.. But she is funny about chemicals. (we had ants at work for years and she wouldn't use any poison or hire an exterminator. Eventually when they made a giant colony inside my new scanner, she begrudgingly gave in.) She was very excited to see my e-cig and she and her husband were thrilled that I was doing this. They are both ex-smokers who quit cold turkey. But when she asked to see it and I demonstrated, the next day she asked that I don't use it there because she "thought she smelled nicotine on her sweater when she got home." Bless her heart. I honestly believe she really did think she smelled nicotine, because of her weird thing with chemicals.

Where I used to work, there was a major discussion going on about banning smoking from the premises completely. For those of us that smoked, that felt like a very discriminatory issue, but the company was well within its rights, especially as a county government agency. I wish I had known about the ecig back then, because I could have stealth vaped in the break room and the rest room. I guess when a company does have rules like no smoking or even vaping, you have to respect those wishes, unless you can fly under the radar...
