Shisha which is oiled tobacco gets cooked not burnt, which is why fresh hookah is always cool and fresh, but i guess the tobacco does eventually start combusting as it heats up, not necessarily bursting into flames, but burning.

I don't see the relevance of your comment to what was said. The founding fathers did not compose the bill of rights to GIVE anyone rights. The document was to PROTECT the rights that were god given.
