US House Appropriations Cmte bill would prohibit FDA from enforcing the February 15, 2007 grandfather date for newly deemed tobacco products (including e-cigarettes), move grandfather date to issuance of Final Rule for Deeming Regulation (allowing newly deemed tobacco and e-cigarette products now on the market to remain legal, but require FDA approval of PMTA’s for new products after Final Rule issuance).

Please note this appropriations bill would essentially enact Rep. Tom Cole’s bill (HR 2058) into law.


The ANTZ just found out, and are going nuts.
Note that I also posted a similar note on the FDA News thread because this is Congressional legislation that heavily impacts the FDA's proposed deeming regulation.

What is the best approach when contacting my congress-person on this? Or should I? Sounds kinda funny to ask them to support an appropriations bill. I could ask them to support Tom Cole's bill, but if the appropriations bill gets passed, isn't it a moot point?

It isn't. The appropriations bill is valid for one year of funding. Tom Cole's bill would be valid forever.

You have to love this quote from the CBS article DCBD posted:

The bill "is nothing short of a giveaway to the tobacco industry," said New York Rep. Nita Lowey, the top Democrat on the Appropriations Committee.

No, Ms Lowey, quite the opposite: banning the sale of 99%+ of vapor products, while cigarettes remain on the market, is a direct giveaway to the tobacco industry. Allowing the existing vapor market to continue, where the vast majority of companies are small (and hence cannot afford onerous regulatory requirements) and have no relation to tobacco companies whatsoever, actually harms the tobacco companies.

But, alas, that would require critical thinking skills way beyond the (often pro-ANTZ) mainstream media.

No, Ms Lowey, quite the opposite: banning the sale of 99%+ of vapor products, while cigarettes remain on the market, is a direct giveaway to the tobacco industry. Allowing the existing vapor market to continue, where the vast majority of companies are small (and hence cannot afford onerous regulatory requirements) and have no relation to tobacco companies whatsoever, actually harms the tobacco companies.

But, alas, that would require critical thinking skills way beyond the (often pro-ANTZ) mainstream media.

Not to mention that the FDA admits they don't have the staff to handle the number of applications their regulations would cause anyway. So they will just issue a de facto ban.

God I hope the ANTZ don't mess this up for us :ohmy:
If this turns out to be the proverbial "line in the sand" then maybe it's finally on.
And maybe, just maybe, we can get some much needed positive attention focused on us.

Yeah, one can dream.

Big Pharma funded ALA's press release is at
American Lung Association Statement on House of Representatives Committee on Appropriations Action to Undermine Tobacco Control Act - American Lung Association

Although ALA's press release contains many more false fear mongering claims, they finally acknowledged that FDA’s proposed deeming regulation would ban virtually all nicotine e-cigarettes now on the market (by acknowledging that the deeming regulation would require all e-cigs now on the market to obtain premarket approval by the FDA in order to remain legal).

But then my brain broke from hitting it on all those brick walls.

They don't say "all", but they say "thousands". IMO, that is a far cry from such acknowledgement, even implied. Either way, The American Lung Association seems to prefer my American lungs to go back to taking in tobacco smoke rather than vapor.

I don't accept the excuse that they're idiots. They know what they're doing, as far as what their concerns are (money). They like to think the idiots are the public.
