I guess there is going to be months of wrangling but from the list of things they are adding, the deeming date is small potatoes...

They mention it saying it would stop review, which from the wording at the start of the thread doesn't seem to match. It read more like you can't proceed with 2007, only the date you publish the rule. Not you cannot proceed.

This could end up working in the favor of vaping, looking at the list of things, moving the deeming date has to be more palatable than everything else I see there.

But would a stalemate on the bill that changes the date hold up the entire budget, or just hold up the agricultural bill? In other words, could it result in government shutdown?

I think the mainstream media would use it to further lambaste anyone who is not a Democrat.
Isn't that pretty much what the "unbiased" mainstream media generally does?
The mainstream media is way too easy on both the Democrats and the Republicans. They should be screaming about both parties every day.

I don't know, from the little bit I do... Both sides want stuff the other won't want to give but are the dems really willing to sacrifice some of the much bigger ticket items for the deeming date? That is what i doubt. Especially since, and please someone correct me if I am wrong but it does NOT say you cannot regulate fda, it says you can regulate providing the grandfather date is not 2007. Given that I doubt they would pull a risky move that could also slow down any regulation.

The antz are nuts and vocal but there are lots of bigger louder groups affected by some of the stuff the GOP added in, like defunding obamacare say.

All speculative, but i am quietly optimistic. I guess it begs the question does say, provape, for example stay in the market if they can only sell the models they have on sale when the final grandfather date kicks in...

I am decidedly anti-corruption. Both parties are corrupt.

Nice dodge. It was about the major media handling of individuals in the parties. But the amount of evidence that could be brought to bear, is not worth the effort. Just pointing it out was, however.

I don't think there aren't some - rather anecdotal incidents - that go against the general flow of news in the major media - for example, the liberal media will pump up Republican candidates a year before an election that they think can be beaten - McCain is an example, but Bob Dole (over Steve Forbes), GHW Bush (over Reagan in the primaries), and currently Jeb (over R.Paul, T. Cruz, S. Walker). But then as soon as they become the candidate, the attack begins. Similarly on the Left but propping up their favorite and downplaying their opponents. And in cases where a Dem has acted so badly, that no rational or even partisan can get passed their actions - there will be a 'downgrading' usually pointing out all the "good" things they have done. And then in some cases - Bill Clinton - after enough time has gone by, they're resurrected as the party's leader :facepalm: And Sharpton gets a TV show. :lol:

That said, the effort of bringing forth the quantity of examples on 'my' side, is not nearly as great as would be getting you to accept them. Along the lines of getting the Pope to consider atheism, or George Carlin to believe in God.

Funding on FDA tobacco restrictions may be held up - Winston-Salem Journal: Local Business

"The bill does not allow funding to implement and maintain substantial equivalent restrictions with a Feb. 15, 2007, grandfather date.

Instead, funding would be permitted for substantial equivalent restrictions with a start date 21 months after the effective date of the final FDA regulatory rule.

The FDA could issue its final regulatory rule any day, although several advocates and industry officials say they may not be unveiled for several months."

"After the November general election, three key Republican congressional leaders, including House Speaker John Boehner, sent a letter to FDA Commissioner Margaret Hamburg and Mitch Zeller, director of the agency's Center for Tobacco Products. The GOP leaders asked the FDA officials to allow product innovation and enhancements to be grandfathered to April 25, 2014.

House Bill 2058, introduced April 28 by Rep. Tom Cole, R-Okla., also would change the grandfather date to 21 months after the effective date of the final FDA regulatory rule.

“This is a side step around those regulations, instead of the Cole bill, which would directly amend it or just revoke the law itself,” said Gilbert Ross, medical and executive director of the pro-business American Council on Science and Health."

"Committee members also expressed concern that the Feb. 15, 2007, grandfather date “will dramatically add to the FDA’s substantial backlog of currently pending applications and create a regulatory logjam for the agency, diverting its attention from its core mission to promote public health, ensure the safe use of these products and prevent underage use and abuse.”"

Some of the articles on this focus on the burden on the FDA if they don't change the date. This one mentions the Harm Reduction issue that the bill expresses support of. From the bill:
Harm Reduction.
—It is the Committee recommendation that the
FDA consider the benefits of harm reduction as part of evaluations
under the Deeming regulations for tobacco products.

and
Using the 2007 date means
that newly-regulated categories of tobacco products—some of which
have the potential to play an important role in harm reduction, and
some of which hardly existed in commerce before that date—would
face a more onerous approval process than cigarettes.

The article concludes with a quote from Gil Ross:

"“The prospect of facing the application process itself would be sufficiently chilling to prompt many of these small, innovative companies to seek buyout preemptively from Big Tobacco.”"

The bill includes this:
For those products that enter the marketplace after the new
predicate date, it is the Committee’s recommendation that the FDA
provide education to manufacturers on how to complete Premarket
Tobacco Applications and Substantial Equivalence Reports for
newly deemed products. This education could take the form of guid-
ance, webinars, and/or individual meetings with companies. Such
outreach and educational efforts are especially important for small
companies manufacturing products that have not been previously
regulated by the FDA.

I do think the mainstream media (not including Fox News and MSNBC) are biased toward the more centrist candidates in both parties, and that it is a diservice. I also think a lot of bad governing comes from the middle, and that centrist extremism can be not only annoying, but potentially dangerous.

EDIT: "Extreme centrism" would be a better way to say that, rather than "centrist extremism".

I get some new information to use, and sound less stupid during the course of my day.

I like watching them, too. I like reading Kents posts, even the ones I disagree with.

Bill G would laugh at it since he knows how few of the applications even with cigs and cigars ever get approved by the FDA, but I guess someone would still have to address them. In fact, if the deeming went through as planned, I could very easily see the HHS chief, FDA head and Zeller going to Congress to ask for more funds to hire more people. One could sarcastically say that perhaps that's the only reason for the deeming in the first place - to expand the agency. But I'll just stick with the idea that they simply want to have complete control over business and consumers. :)
