Just to add to the discussion, @Fuzzy Thunderbear, I read on Phil Busardo's blog that CASAA states that the FDA Deeming has no bearing on whether or not Vape products are considered tobacco products by a state. Instead, each state is required, individually, to declare that vaping products are tobacco. If that is the case, and South Dakota has not yet named them such, I would think you could still receive vaping products from online sources. (Bear in mind, however, that CASAA goes on to say that with the FDA's new stance, it will make it easier and more likely that individual states will start the process of declaring vaping to be the equivalent of smoking and, thus, all products are tobacco products... :()

1. So to further contribute to my laziness, I just found out that I no longer have to go to the grocery store...Walmart now lets you pick out everything online and they will get it off the shelves and bag it up for you and you just pick a time to go pick it up!:thumbs: Now that's right up my alley since I hate having to navigate the aisles there and dealing with all the idiots! ;)

While that might be true (and valid in most states), our governing body is taking the chicken's way out. Because they already do not allow shipping of tobacco products and because the FDA Deeming at least implies all vaping products to be tobacco products, this stupid state is taking the easy path. That is, they seem to believe that because the Feds have so declared, the state doesn't have to; they intend to comply with federal edict and have decided that vaping products are tobacco products without passing a law so stating. In other words, our stupid governor (and he's a Republican, but he has clearly been bought and paid for) has pulled an Obama (over-reach via unconstitutional and illegal executive orders) and has simply said vaping is tobacco. Therefore, all state agencies will comply. Sucks, doesn't it?

By the way, I intend to work hard at the next election to get that jerk removed from the office.

Good morning everyone, the morning seems to be going pretty good, gotta leave a little early today so I can run to the ATM machine and get enough cash for my doctors appointment this afternoon. For some reason they only accept cash.. Ugh.. And when I get off I have to go straight to the appointment or I will be late.

They did pass a law, Rich. It's in the statutes. "E-cigarettes" and "vapor products" have been deemed by the South Dakota state legislature to be "tobacco products."

34-46-20. Tobacco product includes vapor product. For the purposes of §§ 34-46-2 to 34-46-6, inclusive, and 34-46-21, the term, tobacco product, includes vapor product. The term, vapor product, means any noncombustible product containing nicotine that employs a heating element, power source, electronic circuit, or other electronic, chemical, or mechanical means, regardless of shape or size, that can be used to produce vapor from nicotine in a solution or other form. The term, vapor product, includes any electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, or similar product or device and any vapor cartridge or other container of nicotine in a solution or other form that is intended to be used with or in an electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, or similar product or device. The term, vapor product, does not include any product approved by the United States Food and Drug Administration for sale as tobacco cessation products and marketed and sold solely for that purpose.

Covers just about everything the FDA covered. I think they copied their paper.
