New proposal for Indianapolis smoking ban includes e-cigs (possible January 9th vote!)

Last week, the Indiana Senate amended and then approved legislation to ban smoking in most workplaces.

The amendment exempted some additional facilities from the proposed ban.

This week a House-Senate conference committee will begin negotiating a compromise between House approved bill and the Senate approved bill. If they can agree to a compromise on the legislation (referrred to as a conference committee report), the House and Senate are likely to vote in support of the compromise, and it would then go to the Governor for him to sign or veto.

Yesterday, the Indy Star wrote an editorial urging the legislature to enact the legislation

If/when that occurs, there is likely to be few if any local smoking bans in the near future in local jurisdictions throughout Indiana. But since the state legislation contains lots of exemptions, I suspect that another bill will be introduced in Indiananopolis/Marion County in the future that would again seek to ban smoking in all bars and to also ban e-cigarette use in all workplaces.

Today Mayor Ballard's office responded to the email I sent in January:

Dear AlmightyGod:

Thank you for contacting Mayor Ballard's office about the proposals to expand the smoking ban. Mayor Ballard signed a proposal to expand the smoking ban because it was a commonsense next step to improve the health of our city. The newly expanded ban now includes areas where there was broad agreement, including bars, bowling alleys and hotels, while still respecting the business interests of tobacco specialty bars, retail tobacco stores and private membership clubs. The new proposal will be in effect on June 1, 2012.

I received the same letter, which failed to even address the e-cigarette usage ban that I urged Mayor Ballard to veto.
