I suspect e-cig equipment, minus the nicotine,will morph into "flavor vaporizers" or something like that, to circumvent bans.
No nicotine=no e-cig.

NY doesn't have jurisdiction anywhere else and since buying and using PVs will not be part of the ban, I don't see how it could affect mail order to NY from other states at all....but then again, I'm no legal expert.

The FDA already stopped this from happening when they said they found trace amts of nictonie in juice marked zero mg. We know that some tobacco flavor that comes from tobacco will have a trace amt of nic, but not the other flavors. They don't care. Look, they want us to either smoke or use Big Pharma products, it's called Corporate Fascism and it's here BIG TIME!

I had a worthwhile meeting with my assemblyman. He's still forming an opinion, but I'm fairly certain that he at least understands the issue now.

One interesting thing was when he realized that the argument wasn't against them being regulated, it was against them being banned.

The meeting was supposed to be 30 minutes, I arrived thirty minutes early, and we started immediately, we ended about 30 minutes late. Bad for my next appointment, but a good sign for the meeting.

I setup a 510 in front of him and his aide tried it out. No nicotine. We joked about how hard it would be for a kid to hide a habit like this... the startup costs, and things like that. He filmed her trying them out.

He not only kept, but asked for copies of all the reference materials. He seemed genuinely interested.

Apparently Roswell Park Cancer institute is against E-cigarettes and is presenting information on the other side... I think someone may need to talk to Roswell next...

He has my number and wanted to talk with me more about e-cigarettes.

I tried to stay away from speculation, others hearing the presentation speculated enough for me.

With the exception of one question, could these devices be used for illegal purposes, the presentation went smoothly. The idea struck me as ludicrous, but I took my time and rationally pointed out that anything could be used in any number of unintended ways.

I'll keep you guys informed as I learn/hear more.

of course Roswells against it. They make there money taking care of Cancer Patents. and they do an excellent job at it. (yes i know pwoplw who have worked there and heve been treated there) If people switch over to e-cigs than the cancer rate "May " drop. and that would hurt there business in the long run. Any Medical group is in business to make money. and they make money by treating the sick. If people arent getting sick, theres no money in it.

MAOI is 50% of the smoking addiction, that's why some feel a little uneasy even with the e-cig the first few weeks. Nicotine without carbon monoxide is less addicting and more like the gumm and patches. Even blood vessel restriction caused by nicotine isn't too bad if it's not delivered via a cigarette.

I posted my letter from Ohio Rep Brown elsewhere on the forum, but I'll post here for you to read. Not great news.

Here's my letter back from My Ohio rep sherrod Brown. It seems what I said to him went over his head.


Dear (Mr Edison),
Thank you for sharing your views on electronic cigarettes and for taking the time to write about your experiences.

Electronic cigarettes are an alternative to tobacco cigarettes designed to deliver nicotine or other substances in the form of a vapor. They have a rechargeable heating component that warms an internal cartridge containing the nicotine and converts the contents of the cartridge into an inhalable substance.

In September 2010, The Food and Drug Administration (FDA) stated that the production quality of electronic cigarettes is substandard or non-existent in terms of Federal health standards which are in place to protect the public’s well-being. The FDA tested cartridges labeled as containing no nicotine but in fact, did contain nicotine. Additionally, after testing cartridges with the same label, the FDA found drastically different amounts of nicotine in each of the cartridges. Consumers should be able to trust a label and not unknowingly inhale nicotine or higher levels of nicotine as many are when using electronic cigarettes.

Consequently, the FDA sent letters to five electronic cigarette distributors citing violations of the Federal Food, Drug, and Cosmetic Act (FDCA). The FDA has stated that if the Electronic Cigarette Association is willing to cooperate with the Federal Agency, it is possible for the product to receive FDA approval.

I will continue to monitor this situation with your letter in mind. Thank you again for being in touch with me.

Good news for New York! See this thread about Senator Owen Johnson's newly presented bill that prohibits sales to minors:

This new competing bill is VERY good news for New York. It certainly does trump Rosenthal's evil and misguided attempt at an all out sales ban. Here it is: S2926-2011 - NY Senate Open Legislation - Prohibits the sale of electronic cigarettes to minors - New York State Senate

Johnson also sponsored a similar bill last year, that only prohibited sales to minors. He had no co-sponsors, and it got nowhere, although in our lobbying to the Senate Health Committee last year we asked them to EITHER remove section two from Rosenthal and Klein's bills, OR to support Johnson's bill.

The excellent news now is that Johnson has several co-sponsors this year. We need to support it, and again urge Senators to either vote and push for this one, or at least to amend Section 2 out of Rosenthal and Klein's bill.

We also need to find an Assembly member or members who will introduce an identical bill in the Assembly, so it can triumph over Rosenthal's bill there.
