I am so sick and tired of politicians sticking their noses in our personal affairs! I now I am going to vote against the majority of the current administration.
For the following reasons, A9529 needs to be amended to remove the text (lines 37-46) that would make it illegal to sell "electronic cigarettes" in the state of New York to anyone, regardless of age:
1. Tens of thousands of New Yorkers have been able to replace all of their tobacco cigarettes with vaporized nicotine from an electronic cigarette.
2. As a result of no longer inhaling tar, carbon monoxide, particulates, thousands of toxins and hundreds of carcinogens that are in cigarette smoke, those who have switched are experiencing improvements in their lung health and markers of cardiovascular health. 3. Electronic cigarettes are not targeted to young people. A University of Alberta survey shows that 87% of users are older than 31 years and all were previous smokers. http://www.tobaccoharmreduction.org/wpapers/011v1.pdf
4. The FDA test report failed to specify the quantity of carcinogens (TSNAs) it found in e-cigarette; however Health New Zealand conducted tests and determined the quantity is 8 ng/g, which matches the quantity found in a nicotine patch. http://www.healthnz.co.nz/DublinEcigBenchtopHandout.pdf
5. Approximately 60% of electronic cigarette users would go back to tobacco cigarettes, which deliver a daily dose of 5,5000 to 11,000 ng/g of TSNAs, if electronic cigarettes are banned.
Banning the sale of electronic cigarettes would create a public health crisis, as thousands of former smokers relapse. It would also make these products unavailable as a less-harmful alternative for the millions of continuing smokers. P.S. After smoking for 45 years, and trying you-name-it to quit, I switched to an electronic cigarette on 3/27/2009 and have been smoke-free ever since. One of the businesses from which I order supplies is headquartered in New York. As written, A9529 would put this life-saving company out of business.

Vocaleck, you do a WONDERFUL job of trying to make politicians understand the reduced dangers, and the true facts of the differences. I have to commend you highly.
My thought though, is does this really matter to politicians? Are they really worried about our health?
Would it not be easier to explain the difference of people quitting cigarettes for PV's in something they understand? Cold hard cash numbers?
Many here figure states are trying to outlaw these, not because of the "dangers" but rather because of the lost tax revenue in cigarettes.
Can we not figure out some fuzzy numbers of the people who have switched, and will actually living longer? Show how much sales tax on other daily purchased items, property tax, wheel tax, fuel tax and any other "i'm living" tax will be collected, and show that it's in their best interest to keep people alive longer and off cigatettes, instead of trying to get them back on cigarettes for the short term tax collection before they do croak off early?
Actually, some politicians do listen. We sent lots of emails to the politicians in Utah, telling our personal stories, and some of those legislators listened. Utah kept the prohibition against sales to minors but amended the bill to eliminate banning all sales.
Have you heard the story of the guy who kept going up to women in bar and asking "Will you sleep with me?" The usual response was that he got a slap across the face. The bartender watched this and finally asked the guy, "Are you a glutton for punishment? You keep getting slapped across the face." The guy replied. "I don't mind. For every 99 slaps in the face, I get one women who takes me up on the offer."
PURPOSE OR GENERAL IDEA OF BILL: This bill seeks to ban the sale and
distribution of items containing or delivering nicotine that are not
currently classified as tobacco products or approved as tobacco use
cessation or harm reduction products by the U.S. Food and Drug Administration (FDA) and also to prevent minors from purchasing these products
I did a little Excel -> Word magic on the list Janet provided so that the email addresses can be copied and pasted into the "TO" field more easily. I "chunked" them because most email programs choke up if you put too many addresses in the To field. I sent several sets of messages out, but this was SOOOO much faster than typing into those dern forms. Thanks again to Janet!

Sun, maybe you can explain to me what part of Judge Leon's ruling that E-cigarettes were Tobacco Products, that the NY legislature failed to understand. I read his ruling to mean that the FDA was to regulate them as tobacco products.
If the FDA would classify them correctly they would automatically be banned to minors. Minors getting e-cigarettes, if they are getting them, is the FDA's fault.
Has one goverment agency took over our government, including the courts?
Actually, the prevailing thought of many ecig/anti tobacco experts is that this a concerted effort by the anti smoking groups (largely funded by Big Pharma) targeting specific legislators and not a tax issue. The other legislators just follow along, thinking this could be a "no brainer" win to take back in triumph to their constituents.Just a thought here...
