So, when the appeals court up holds Judge Leon's decision and drops the stay, will NY step in and start taxing e-cigs or will NY citizens have to wait for the final outcome of the SE-njoy case in total?

To me, this seems that NY is setting itself up to tax e-cigs as soon as they are classified as a tobacco product.

All of this is not worrying to me at this point. I believe the SE-Njoy case will, eventually, make the e-cigs a tobacco product by law. At that point taxes will begin being imposed. Also at that point I (and many others) will have their PVs of choice and will be able to make their own juice. So the only two items outside of our control will be attys and nicotine juice. If these items are taxed in line with most other consumables, I would have no problem with that.

However, if the federal and state taxes were set at the abusive levels of cigarette tobacco rates, it will be time for HIGH profile protesting on the scale of the original tea parties of Boston.

After all, this is history repeating itself. England was abusing the colonies with their abusive taxes. Now it is our own government that is being even more abusive to its citizens. We can not allow this! We the people must demand our representatives work for us, not the highest bidder.

The problem is that they will already have passed laws to ban the sale of e cigs (although the e cig doesn't have to have nicotine in it). Now the Pact Act will get approved prohibiting internet sales effectively shutting down any legitimate sale other than......cigarettes. SWEET:evil:

Another good reason to have the FDA classify these as tobacco products. If it's not classified one way or the other, states will use that as a way to ban them. If states can't outright ban tobacco products, they can't outright ban ecigs IF they are tobacco products. I can see no reason why they can't ban "drug delivery devices."

This is why we can't wait for some magical "third classification" as a reduced harm product.

Come on New York vapers!! Contact CASAA with your state senator/house contact info and we'll get a campaign going!! We have to expose the lie to the other reps who will vote on this.

I would love for them to see the truth but they will not listen. Here in NY the avg. price on a carton of cigs is about $80.00 plus with the tax being around $50.00 of that. Hell the state has lost in me alone $400.00 a month in taxes alone, yes that figure for me is correct. Now compound that figure over how many people would leave smoking for Ecigs and that number becomes incredible.

The Bill is to take effect immediately if passed. Interesting thing reading this bill. The 3rd option is even addressed via relation to the FDA.

I did comment

I think that maybe I wills send each a care package..one card with A cigarettes (won't tell them their stale from months ago hehe) And a PV. Both attached to a card- with a saying..your significant other or child is an addict..which would you pick? Or won't you give them the option?

Am I reading to much into the above quote by pointing out the word CURRENTLY? To me, that reads that despite the eventual court ruling, their sale would still be banned since at this time they are not considered a tobacco product or FDA approved.

NY politicians are such tax whores. They raised the tax on cigarettes so high, their own citizens began crossing state lines to buy smokes or chose to order cigarettes online. What did the scummy NY politicians do in return? They pushed the PACT Act, because they somehow believe they have a god given right to collect outrageously high taxes from the population. And with PACT, their citizens won't be able to escape high taxes by ordering online.

This bill is just another attempt by NY politicians to INSURE they get those high cigarette taxes. We can't have citizens vaping while escaping the high cigarette taxes, no more than we can have citizens buying more reasonably priced cigarettes over the net. Scumbucket NY politicians could not care less about your health, because it's so much more profitable if you continue smoking instead of vaping.

NY politicians need to crawl back into whatever slimy gutter from whence they came.

Or the carpet adhesive use to make cigs FSC.

I did leavea comment - basically saying I was approving of the no sale to minors and digusted by the hyposcrisy of the 2nd part - telling people its ok to smoke, and die from smoking providing NYS gets its tax money first. To date I see no comments listed for this article at all.

I posted almost 48 hours and it has yet to appear :mad::mad::mad:

In NY- we pay over $8 a pack for smokes. Our state budget is in complete bankruptcy. We've had one, no, now 2 disgraced Governors. The State continues to fight Indian ability to sell tobacco to non-natives from the reservations (the latest attempt is to allot a certain number of tax free smokes to each tribe based on their number of members and average consumption). This e-cig ban will likely pass easily and with no regard to the wishes of the majority. The loud mouthed anti-nicotine movement will give legitimacy to the tax mongering, and we will all pay with taxes and our health.

Try living in NYC. In December I was paying $10.50 a pack when you include the sales tax on top of the 3 (federal, state and city) excise taxes.

This all started when Bloomberg first got a city excise tax on cigs right after he became mayor. He insisted it wasn't about the money, it was to keep kids from smoking. And then all these adults started buying their cigarettes online, tax revenue dropped and it suddenly became about the money (although he still insisted it wasn't.)

lols our governors kind on keep shifting in and out of office recently.
