I guess it just depends on where you live. I am in Charlotte and went to madvapes Sunday and my wife asked the lady that worked there about a cop seeing it because she was nervous. Lady said cops come in all the time and get ecigs. I just brushed it off like probably not but if it calmed my wife's nerves then good because we abide by laws. Well I went there again yesterday and got a chuckle as a uniformed cop in a marked car walked out with his ejuice while we walked in.

Glad the cops in your area are more educated! The cops in my area (the county ones moreso than the city ones) are notorious idjits, but this evening REALLY took the cake. It took the whole damned bakery, actually.

honestly depending on the area it can be very easily mistaken for drug paraphernalia. there is two shops local to me that sell items that are popular in the hip-hop community and are not meant for eliquid but look exactly like a ego style battery. i get asked all the time what it is and no one believes its for nicotine till i pull out a bottle and show them.

while the officer was definitely out of line, he likely had little experience with ecigs. hell mall kiosk employee's of a lot of rip off brand companies have no idea about ecigs. the one in the mall i work at, all the employee's were never smokers, have no idea what a mod looks like and have only heard about them from the press. one lady even told me to becareful because after 3 months the risk of failure is 99% while trying to sell me a 808 kit with on battery and 5 cartridges for 80 bucks. next day i brought in articles and notes for her and even showed her my invoice. her response was well the liquid you buy comes from china and that will kill me and her stuff is all usa made. she then told me i was a liar when i told her i make my own liquid and buy from us based sources. since its impossible to make liquid at home. youtube cleared that up, which followed her putting a complaint into mall security that i was bothering her customers, when no one was there.

just that alone from someone that sells them shows how little the public knows about and understands e-cigs. best thing you can do is keep a business card in your wallet/purse and use the labeled bottle when out and about to avoid this type of issues. hopefully vaping comes more to the forefront and issues like this cant wont happen anymore.

Lol, totally understandable. I've heard smoking --other smokables-- referred to as "smoking a bowl." I can totally see where the confusion came from. And thanks for the post anyway - if I had smoked something else, the reminder to clear my post of that evidence before I went to the media would have been helpful. :)

If I were you I would edit that post for the sake of clarity because it didn't sound right to me when I first read it but I did remember that you said you were a pipe smoker. Just Sayin'.

You should post the phone number of the police station here (it is allowed because it is public information) so that the rest of us can call to complain as well. There is strength in numbers!

I would gladly call (I have 5 cent/minute calling Canada/US) to complain that a LEO would recommend that a person should smoke!
I'm sure many others would, as well! Let's just call it a "Wake UP Call"!!!

Wow, sounds like you are young and driving an older car, black, have an accent, out of State plates in a small town, or some other issue. I've never been hassled about driving while vaping, and I vape constantly driving. But, I've been pulled over for no other reason than being young and driving an older car (ten years ago) and treated poorly, and got the same treatment when I had out of State plates in a small town for several months after moving there and got pulled over and treated like crap (before I started pointedly mentioning the address on my license, then got new plates). I'm glad I'm not black or have a non-standard accent. Police can be dicks sometimes, just like grocery store clerks and corporate CEOs can be dicks sometimes. But when you're dealing with the police all you can do is be polite, cry if you can (good job), admit you are powerless, and say nothing. Unless you are recording everything or are a lawyer, in which case, good on you.

I live in a dry county. That means, if you are carrying around a styrofoam cup at a street festival, and it smells like alcohol, but isn't marked, a police officer can ask you what is in it, etc.

I carry my liquids labelled. I also carry the business cards that i get with my liquids in my glove compartment. It would help the officer *identify* what I'm sucking on. :) No sense not trying to be informative and practical at least.

I used to listen to janice joplin et. al and never did any drugs. I am almost 60 and listen to hip hop, and appreciate the dance moves as well.

Not sure what a *hip hop community* is though? Just never heard that term applied to a whole community......when I lived near Yale University all the college students went out to clubs on the weekend and danced to hip hop. I don't know if that implies they are part of this hip hop community you speak of? I guess it does.

You probably won't get much of a response filling a complaint. Asking what the laws are about e-cigarettes will get you a blank stare, unless someone there also vapes.

My "boss" is a former police chief of the area I'm at. He asked me one day "What are those things on your desk?" (2 eGo's with cartomizers and 1 eGo-T Upgrade with a 6ml tank). So I had to explain it to him.. He just shook his head and walked back into his office. Later, he just said "Well, as long as you're not smoking now.." Doesn't even mind if I do it it the office.
I do go out side now and then, several others in my office smoke and I miss the standing around with them.. Deputies and Police are all around. Only one has asked me what it was I had. He liked the explanation. The rest just don't care.

Just keep in mind that the way things are now, a LEO can pull you over and question anything. If he/she doesn't like your answer, or understand it, they may still arrest you and confiscate anything they find. It doesn't matter if what you are doing is legal. You may or may not get your stuff back, even when proven Not Guilty. (removed).. (let's not even mention unlabeled prescriptions....) o_O

Sorry lol. Just whenever I was doing that in my younger dumber days we would always refer to the act as smoking a bowl. My father has smoked a pipe for as long as I can remember and never heard him call it that.

if you do contact the PO, please do so calmly, without anger or accusations! I'm someone who will complain (and complement if that is the case). I have learned that you get MUCH better results if you say things like, "I though you'd like to know" and just calmly state the facts.
I'm old (I love being old) so I would have probably refused to dump out anything and would also be taken to jail :)

I am with you, but before they arrested me, I would have requested the officer got out the drug test kit he had in his trunk and tested the liquid.

Thanks for the support, you guys. I was so upset at the time, I didn't even get the cop's name. Should have. Anyway, I'm going to go down to my local police station in person tomorrow morning (it's on my way anyways) and ask about what this cop told me. I'll take my Riva-T, and my (empty) needle-tipped bottle to show them. I'll let you know what I find out. I'm always nice to people, especially cops, and this time will be no different. No matter how angry I am, I'll be nice.

Now that I'm not so shakey, I'm starting to get a little pissy. I think if the PD confirms I wasn't doing anything wrong, I'm going to try to lodge a complaint against the guy. I don't know if I can do that without knowing his name, but I'm going to try. I'd like to go after him for harrassment, but I can't really afford a lawyer. Man, what a trip.

Bullies like him shouldn't be allowed to be cops! They give the rest of them a terrible name. :grr:

A news station is a wonderful idea. Our local news is pretty damn good, and always looking for a reason to hassle our police department. I'll get in touch with them tomorrow as well.

I'm really, really glad I've got you guys. I think even if I didn't have anybody to back me up, I'd have gathered my wits about me and gone to the OPD tomorrow to straighten things out anyway, but you guys have made me feel so much better. *hugs*


EDIT: It was a Sheriff's Deputy that got me, not city police. I'm more or less in the city, but I'm technically right outside city limits. I got caught like four miles outside city limits, by a county cop. Way to play into the "county cops are ......" stereotype, amirite?

OP, where he ran your info, there are records and they can easily find out who it was. On top of all of that I would ask if there has been other complaints against that officer, if so make a note of them. That way if something comes of this later you have more info on the character of the officer in question.


Actually by law in the states, it is required that if you carry meds to have proof it belongs to you and that it was prescribed...

If your kid or someone elses kid drops his Ritalin (methylphenidate) you will probably (90% you will) be arrested for drug possession if you consent to a search (which you NEVER do, no matter what the situation)


Most of the time I will agree with that, however anyone who holds a CDL riskes losing their drivers which means their job if they do NOT allow it.

There are good and bad cops and the bad ones can get real nasty if you go up against them. You need to do some research for your area on whether or not there might be repercussions if you complain to them or report to your local meda. I know that sounds paranoid but I've seen a lot. The main thing any journalist will get at is that he made you dump an unlabeled, alledgedly "illegal" substance used in the "paraphernalia" meaning (unmentionable here) on the ground?... for wildlife, pets or anyone to get into? and that he basically threatened you with loss of your license. This is insane and power crazy and that's why I mentioned research and caution. He sounds on the edge to me or got off on intimidating those he sees as "weaker." Sick. I'm sorry this happened to you and, frankly, I hope someone gets incidents like this in national media view.

Wow! didn't read far enough and just saw it was a Deputy... stand by what I said even more so. I'm rural and, though I'm out West, I think they're all mostly "cowboys"... ya know.. in the negative sense. I love real cowboys.

You should have got his name and badge number and reported him for harassment. Completely uncalled for.

I would have asked for that the second he accused an APV of being used for something illicit. I would not even be particularly polite about it. Badge number. You're Captain will be hearing from my lawyer. Have a nice day.

first, and i cannot go into details but the use of electonic vaping devices have been linked to usages for "other" things you can inhale.
(do not ask me what they are, as i will not and cannot answer that without violating the ECF rules)

second, I would seriously file a complaint with his supervisor. No, i am not kidding. You could actually sue his department for harassment. Ecigs are still kind of new but there is no excuse for him to put you through all that after you explained the situation. Having your pour out the juice was kind of extreme. While officers DO in fact have quite a bit of self regulation and leeway in how they enforce, there is a point which they cannot proceed. Ask for a copy of the incident report, to put you through a field sobriety test he likely would have had to fill one out. Im assuming you were using an ego type PV? if so what was his cause to pull you? they dont produce a light afaik, so all he saw was you smoking something, which he did not know what is was and thus could not detemine the legality of it. Think of this like a cop seeing you drinking a can of something and pulls you to find out its coca cola and then puts you through all the stuff you went through.

finally i will say to you this, find a e juice dealer that labels their stuff and carry a small bottle of that with you. I think what made the cop feel wonky about your setup was the large needle on the end of the bottle. and possibly the look of your e cig. uneducated people can be the worst, esp if they have a badge.
