This is nothing more than the powers that be trying to make money.
Where there is a will, there is a way.... FDA always paves that way.... It is our job to find the shortcuts.

Kevin my friend, have you read the proposed regulations yet? I am on page 140 of 241 and there is the distinct possibility that all products derived from tobacco will be covered including premium cigars. In any case, anyone making or modifying a tobacco product and selling it regardless of how or what will be a manufacturer and subject to all the requirements of any tobacco manufacturer. Those requirements would be impossible for anyone but a large firm with large $ to do. Even if it contains no nicotine the documents and lab reports to show that it contains no nicotine have to be submitted or else it is a tobacco product as far as the FDA is concerned. And even if they give an exemption then it still has to bear the warning "This product is derived from tobacco".

The lone positive thing I have ran across is that "covered tobacco products" will be treated consistent with cigarettes and smokeless tobacco "In current part 1140, FDA imposes restrictions on cigarettes and smokeless tobacco, but not on the components, parts, and accessories of such products. FDA believes that applying the minimum age and identification restrictions to covered tobacco products only (and not to the components and parts that do not contain nicotine or tobacco) would be sufficient to protect the public health, because youth will not be able to use such components and parts and potentially suffer the consequences without also obtaining the covered tobacco product. In the event that FDA determines it is appropriate for the protection of the public health to extend the restrictions in part 1140 to components and parts that do not contain nicotine or tobacco in the future, the Agency will issue a new rulemaking and provide notice and opportunity to comment on such proceeding."

CASAA is still evaluating it and might be for awhile before giving it's comments to vapers.
Every vaper should read this and after people that can read legalize better and have our interests in mind give their comments make appropriate comment to the FDA during the stakeholder comment period.
