With just over one month left till the filing date for the FDA's Brief to the Court, there is still no word from SE. SE's and njoy's Briefs are due on June 23, 2010. If SE encounters problems with product coming in, I personally do not see how they can last to see a ruling in the instant case. Only time will tell us.

It appears that contrary to what we have assumed, the FDA has not increased it's seizures of e-cigs, but rather has slowed down considerably, since January.
Perhaps this has to do with Judge Leon's ruling?

See "human and animal drugs" in the report.

It seemed to have at least slowed down and possibly stopped up until just before the stay. Personally though, I've heard rumblings lately, and reports say the Chicago points of entry are currently a hot spot. One supplier confirmed that they had product stopped on the 25th of March and knew of multiple other suppliers currently in the same situation. It also doesn't matter if it's just hardware or not, if it has anything to do with an e-cig it's not going to make it past the FDA. My question is, what are April's reports going to look like?

I was thinking the same thing, it will be interesting to see what April's report looks like.

Tried again how about step by step?

Click on the blue colored link "Import Refusal Report".

You should see the main page, then click on a month (any month).

Then you will see the types of seizures, scroll down to "human and animal drugs". You will see the number of refusals for that month.

Again the FDA strikes and this time the report comes from a consumer. Here is what honestjud reported today:


Howdy everyone. Any help on this subject I would appreciate.

I ordered 53 bottles of eliquid with nicotine in them from China and my tracking number says that it was turned over to customs as of April 2nd. Just got a letter from the United States Food And Drug Administration Chicago District Office today. Says that 53 bottles of nicotine solution are being detained by the post office at the request of the FDA.

The following products are subject to refusal of admission into the United States under authority of Federal Food Drug adn Cosmetic Act (FD&CA). Public Health Service Act (PHSA), or other related acts in that they appear to violate as indicated below.

The article appears to be a new drug without an approved new drug application. Federal FD&C Act (21 U.S.C. section 331) prohibits the interstate shipment / importation of unapproved new drugs. It appears that the drugs you are importing are unapproved new drugs and/or can be purchased in the U.S. YOUR PACKAGE IS NOT HELD AT THE FDA OFFICE. PLEASE DO NOT VISIT THE FDA OFFICE WITHOUT AN APPOINTMENT.

All products of this kind must meet the requirements of the Federal Food Drug and Cosmetic Act or other laws inforced by the US Food and Drug Administration. These laws are designed to protect you from, among other things, unsafe or misrepresented foods, drugs, biologics, cosmetics, devices and other articles. These products do not appear to comply with the law. "But they will let big tobacco sell billions of cigs without listing the contents, yeah they sure are helping to protect us arent they?":sneaky:

This Notice does not in any manner accuse you of violating the law.

If you have a good reason to believe that the products compy with the law and wish to discuss it with us you may come personally to this office or write us. "Haha, guess I'll be licking a stamp.":evil:

Although I posted this somewhere else just to let you know Chicago is poison right now. I had a package taken by the FDA March 21st, is was not listed on the hold list. I received my FDA letter last Friday. Package was 150 batteries and 40 chargers no Juice or Cartridges. And I know of a few other suppliers who have been hit since March 20th. Very scary for suppliers right now in the Mid West since we have to go thru Chicago sometimes.
