Thank you guys. Interesting stuff. So, to summarize when my battery is dead I won't be able to get another unless it is 9 years old? When I run out of juice I can get existing flavours only as long as the recipe and packaging don't change? And that's only for two more years. After that to cover the cost of the "permit" costs will likely be out of reach for the everyday vaper?

So how about the actual act of vaping? Someone in another thread said that too would be illegal.. Hyperbole?

Nick
You'll always be able to get replacement batteries because they're used for many things other than vaping. That is why people here are recommending mods with replaceable batteries. You'll have two years to stock up and then every mod now on the market will be banned unless manufacturers submit applications to the FDA. Very few, if any, will do so. If they do submit an application, they can continue to sell the product for another year or until the FDA acts on the application, whichever comes first.

There are two pieces of legislation pending in Congress to change all of that. Nobody knows whether they will pass. There are multiple lawsuits on file to challenge this. They will ultimately be resolved in US appellate courts. Nobody knows how they will turn out.

Nothing has been proposed at the federal level to prohibit vaping. That's beyond the FDA's jurisdiction and Congress has not granted any agency the authority to prohibit it. Some states and local governments have banned vaping, or have proposed to ban it, in areas where smoking is prohibited.

I wouldn't say it only affects enthusiasts. It affects 90% of the vaping community. Tons of people in my area running around with egos still... They use juice. Not many still on the Carts anymore. Once you go juice it's hard to go back. I bet the majority of people with end up shafted and back on cigs.

The FDA deeming regulations declare that electronic cigarettes are now tobacco products.
The regulations go into effect on August 8th of 2016.

As they stand, only products that were on the market prior to the "grandfather date" are approved.
The grandfather date is February 2007 and there wasn't anything that matters.
So nothing is approved.

Manufacturers have two years to submit a PMTA for approval of a given product.
They can continue to sell existing products in that two year window, or so they say anyway.

If a PMTA submission is not approved that product must be removed from the market.

The cost for submitting a PMTA is astronomical.
And the rules for getting approved are pretty darn near impossible.
So all products on the market will be removed in two years or less, depending.

Everything is a tobacco product.
Batteries, atomizers, zero nicotine liquid, the air you breathe.
EVERYTHING.

After August 8th no NEW products can be introduced without approval.
EVERY single tiny change you can think of is a new product.
So there will be no changes after August 8th.
NONE.

A vape shop can no longer mix liquid, or rebuild coils, or they become a manufacturer.
You can't even change the ink on the label of a bottle of juice.
EVERYTHING would be considered a change.
EVERYTHING.

There are lawsuits challenging a whole array of things.
There are bills in Congress to change the grandfather date to something reasonable.

There is two years, or less, for something to change.
Many are suggesting that two years is wishful thinking though.

There is no way I could even begin to get into what various states may do.
Or what some of them are already doing.
That stuff is likely to happen more quickly, and cause much pain.

That's my attempt to sum it up in one post.
I was bored, and I still have 20 minutes before I leave to pick up dinner.
:)

That is a Pretty Darn Good Summation of things DC2.

And it would Fit Well on a Flyer stapled to an Info Post in a College Quad area. Or in a Handout display at your Local B&M.

If you plan on using Nicotine into the Near Future, I'm Not Sure why a person Wouldn't buy Nicotine Base and then stick it in their Freezer?

Well ya scared me into it. Just loaded up a couple carts. Lol

One more question,

I'll still be able to buy mixing supplies for two years right?

Nick

If you mean, bottles, syringes, flasks, etc - yes - anything that has common purposes in other uses will always be available...

I have 2L my Dad has 1L and I have no idea if we can get it after 8/8 and I'm not sure anyone knows anything for sure to be honest. The FDA regs were written as vaguely as possible.

Still undetermined if I'm going to buy more nic. I have about 9 years worth and if things really are going for good I think that's long enough to quit nic, many here have done so easily and if they force my hand I will.

How about nicotine. I only ordered a liter (100mg/ml) for now. That's a lot but not a lifetimes worth... let's say a month from now... Will I be able to get more do you think?

I don't think you are going to see a Complete halt of Nicotine Base sales in the next Month.

But as we Move Forward, I think you will Probably see Fewer Options as to where you can get things. And Possibly Higher prices.

BTW - What State do you live in?

I'm in Michigan. So is this on a state by state basis? I was under the impression this was a federal law.

Sorry if this has been talked to death... I found a couple threads but they are HUNDREDS off pages long.

I haven't been on this site in a very long time. I quit DIYing years ago and have been content with gas station juice and ego like batteries for about 4 years.

I finally bought a mod today that I saw at a store around here because I was getting annoyed with the battery life on the 650. I get it home and go on here to look it up (had to do a password reset ~ it's been that long), and find all this talk about an FDA ban coming next week. I Google this and it looks like companies just need to"apply" for some sort of license or something. Then I look here and people are talking about vaping being illegal and hoarding nicotine and juice. I honestly hadn't heard about any of this.

    So what's the real story?

In two weeks will I be able to order from FSUSA, Backwoods? Will I be able to buy a new coil when mine is dead? If I run out of juice will I still be able to go up to the gas station and get 10ml for $6? Will it be illegal to vape on the street, in my home, in my car? Or will I end up having to go back to analogs?

I really never heard anything about this. Lol. I feel so uninformed.

    Thanks

It is but it seems the states think they have been given a blank slate and so they are writing in their own rules and in some cases they are just as bad if not worse than what the FDA is doing.

The FDA Deeming Regulations are Nation Wide. That isn't why I asked.

The reason I asked is that States have the ability to Impose their own Regulations/Restrictions on e-Liquids. Or to go Ballistic and Decimate an Industry like what you see here...

CALL TO ACTION! - Updated!! Pennsylvania: 40% tax = game over for vape

Indiana Call to Action - Stop the Monopoly

    Ban in Utah!
