Every day that I read this website I see that ecigs have been banned in different countries. The latest is Holland.
Geeze, you can buy dagga and ....... legally in Amsterdam but not ecigs now.
Won't be long before it is banned here as well so stock up with juice. It will surely come as the juice is not regulated and every Tom, .... and Harry can manufacture the juice and sell it to the public. Sooner than later China will sell you cheaper lethal juice that will send you to lalaland. We all know that this has happened before with the "baby nutrition's" etc etc etc.
This has been my concern for some time now and can understand why it is being banned.
I would prefer it to be controlled and sold by regulated companies.

Yeah time will tell what happens here in the states.
It has just happened. Canada, Holland and now you guys in the US. But I see you have reprieve till end Feb. Not so?
We are actually lucky here in Africa as our gov employees time is taken more on how to siphon money into their private accounts than thinking about ecigs. Lucky us. :)

Oh cr@p. We in trouble now. I just ordered R1000.00 worth of stuff from MV. What supplier are you talking about?

Vaper...hopefully they'll be able to appeal and get their shipment because I consider them a godsend. They appeared to have relatively healthy stock when I was there last so I don't think they'll be totally dry for awhile.

My supplier in Cape Town told me their recent juice shipment was impounded at customs because its now a schedule 3 substance and one has to be a pharmacist to dispense it. :(

I got 2 orders in ofer Des and Jan, one of them was inspected, but nothing was inpounded..... one of the supliers had no invoice, and customs had a issue with it, and they had to pay a penalty for it. But other then that I had no issues importing stuff from USA or China.

So nicotine is a schedule 3 product and can only be distributed at pharmacies? I have never seen cigarettes at pharmacies. Have you?
This will not stand in a court of law. It is ridiculous and I think some custom officer is trying to exercise his "expertize and authority" due to his high intellect and superiority over us mere consumers that don't know nothing. What he says, goes. No argument, full stop.
Sad that to become a customs official you only need to be nearly brain dead and be literate enough to make a cross or a correct sign on a form that they cannot read.
Sorry for the banter, but I run a shop and have had it with these guys bullying and stupidity when they check my stock. They think they are superior with their grade 6 and a badge on the shoulder.

I agree!!! Phone customs and ask them what the problem is... but listen very carfuly now.... DO NOT PAY ANY PENALTY FEES!!!!


If they tell you there is a problem and there will be penalties involved, make it the vendors problem, let the vendor sort it out, either let them refund you, or let them send you another parcel....BUT DO NOT PAY ANY CUSTOM FEES OR PENALTIES !!!!!

Hi, Steve here from Vaper. As mentioned by Plazm (thanks for the kind words!), we had a fairly large shipment impounded by customs in Cape Town, who insist that we need a "section 21 permit" from the Medicines Control Council in order to get the liquids released.

After more than a week of phoning the MCC, leaving messages and many (many!) emails, we finally got a response yesterday from Dr Joey Gouws, who heads the MCC's "Inspectorate & Law Enforcement" division.

Here is her response in full:

Dear Sir

Nicotine substance is regarded a medicine in South Africa. A Schedule 3 status has been allocated to the substance when used for smoke sensation or the likes thereof. This implies that only a Medical Practitioner or a Pharmacist may sell the substance.

In addition, due to the registrability of the product as a medicine based on the indication and use of the product, the product can only be imported by a Licenced company (a license must be obtained from the MCC). Future, the product that you are selling must be registered by the MCC. The MCC registers products after they have evaluated the safety of the product, the efficacy and the quality of the product. The evaluation is based on scientific data compiled by the company through clinical studies and submitted to the MCC. All applications for registration goes through the MCC for consideration and evaluation of safety, quality and efficacy on the health of the public.

I regret that the MCC does not register a product based on the certificates or reports from other countries.

Section 21 application is only applicable to new novice substances or substances not available in our country and of lifesaving importance. You can understand that nicotine liquid is not new, not novice and not life saving.

Customs do not stop each and every consignment of imported products going through the SA borders, the reason for your first consignments being imported without obstacles . It appears that Customs has now stopped your consignment and that they are asking for the following information required when medicine is imported:
1 Licence to Import
2 Registration certificate for a medicine

I regret that without these documents your consignments will not be released. Our office is also in no position to assist you with these documents.

The new Schedules should have been published by now. These Schedules have been finalized and communicated early 2011 and therefore will be published any day as per the Minister of Health's prerogative.

I regret to advise that the safety of the public is paramount to the mandate of the MCC and that financial aspects is not considered by the Council.

My clandestine acquisition of illegal e-liquid from MV worked. Told them to not put any shop labels or content labels on the package. Was sent on Monday and it got to me today(Friday). Still at the Post Office and will collect tomorrow.

As to the above post, I can see why. Nicorettes and other nicotine patches and inhalers can only be bought at pharmacies. So I suppose e-liquid falls into this category as well.
Our time to import seems limited. Dischem will take over at a high price.
