Thanks for posting this Oliver. Isn't it interesting that the entire document isn't available for review?!

Freedom of Information at it's best!
I believe TVECA has the whole document to be released in no
more than two days. Perhaps the are reviewing it first as this
is their scoop so to speak.

This is ridiculous. I just started a month ago, and it got my wife and I both 100% OFF of tobacco. I'm having a hard time understanding why it's all being regulated as a tobacco product. I know that the nicotine is derived from tobacco, but it doesn't actually have any tobacco in it, does it? And vaping with 0mg juice is not even related to tobacco or tobacco use! Ludicrous and greedy.

Ridiculous is an understatement. This comes down to the same thing everything does, the almighty dollar. Vaping has been a positive thing in so many people's lives, mine included, but the reality of the situation is that it takes money out of big tobacco's pockets. Believe me, there lobbyists are paid. The proof that vaping is a healthier alternative to cigarettes is definitely out there. You just have to look.

Screen shot - haven't checked if it differs from the deeming doc we know. But the part where it says 'The term is not limited to...." I don't recall that wording from before. And the "whether they are sold to consumers for use in ENDS...." IOW, like 'closing the loophole' for eliquid unlike on RYO where cig tobacco was labeled 'pipe tobacco'.

Unless it's Senator Burr, Alexander, or others....

Although perhaps you think there's a better chance with Boxer, Feinstein, Markley, Warren, Blumenthal, Durbin or the other dozen Dems that sent a letter to OMB and FDA to speed up the deeming. :facepalm:

So... a 18650 battery or even a laptop battery (with 18650's) is from their pov a tobacco product??

I was specifically going through that looking for how regulation might effect nic base and it's still somewhat vague based on the document alone. (Liquid nicotine defined as a tobacco product but not as a 'finished' tobacco product)

What it does seem to do, is say that a flavor is deemed a tobacco product if it's sold for ecigs. So if you buy bottles of flavorings from Bull City Vapor, those are tobacco products and subject to the regs - but if you buy flavoring bottles from Bull City Flavors, they are not.

    I suspect they are referring to ego style batteries.
    18650s are used in many products.
    But you never know........
    How long do 18650s last in the freezer:facepalm:

    I am still researching, but why is everyone freaking out so bad? It is the table of contents. It is hard to establish much of an opinion on anything when you don't have the document in front of you. I have a hard time seeing them destroy the vaping industry when {OTHER STUFF} is becoming legal. I think everyone needs to take a deep breath.

    I have submitted some things already for this petition, I will see if I can contact my official and do anything more ... back to finding more information.

    They really have no idea what the :censored: they are doing.

    I'm going to wait for the full text. Without it, we're just speculating.

    The 'For example...' line says that batteries (and attys, coils (aerosolizing apparatus)) used in ENDS are tobacco products.

    But this is absurd. Are they seriously going to regulate cotton balls? :facepalm:
