And of course what would truly be tragic if these leaked are essentially the final is Rob Of REO squonker fame. A fantastic guy, a fantastic mechanical, and dare I say one of THE most loyal customer bases on planet Earth or Mars.

I don't work for him but I do own two of them. :)

This whole intended use thing is the ugliest part of their new regulation angle.
And what it really amounts to is an attempted end-around on the Judge Leon ruling from a few years back.

Judge Leon said no to intended use because that is not in the FSPTCA.
The FDA is now saying we'll just make it part of the deeming then.

Shocking.....

So much for "due process"

I will personally attest that this is Not Difficult at all. If you order 120ml bottles, they usually come in an inner pack of two to a tightly sealed bubble-padded envelope. I grab a Sharpie, wrote "NICOTINE" and the date on it, and in the freezer they go.

You wanna know what the hardest part is? Finding room in the freezer. My wife tends to keep it FULL of non-essential stuff like food!

Exactly why you do what I did and get a small chest type freezer just for your nicotine. No food allowed ;)

Right.

I asked CASAA for a new CTA, but so far haven't gotten a response. I thought it might be better if we had an organized letter writing (or calling) effort, but if that's not going to happen, I'm going to write to them anyway.

@Robino1 @JustJulie @Vocalek @kristin

Speaking of calls to action, I know you guys must be very busy right now, but since the last one was so successful, shouldn't CASAA issue a new one?

There is another bill very similar to the HR 2058:

Keller Heckman | The Grandfather Date – What are FDA's Alternatives?

"While it may be unlikely that this bill [HR 2058] ever becomes law given how difficult it is to get anything controversial through Congress, even more recently, Congressman Robert Aderholt introduced a rider to the 2016 Agricultural Spending Bill in the House Appropriations Committee that, similar to the Cole bill, would prohibit FDA from enforcing the February 15, 2007 Grandfather Date for newly deemed tobacco products and move the grandfather date to the effective date of Final Rule for Deeming Regulation. That bill was approved by the Committee on July 8, 2015, but is still unlikely to become law because of opposition in the Senate and the Obama Administration. A good discussion of this issue can be found in the Committee Report starting on page 71: http://appropriations.house.gov/uploadedfiles/hrpt-114-hr-fy2016-agriculture.pdf."

Wouldn't it be worthwhile to issue a new CTA in support of the 2016 Agricultural Spending Bill?

Also, I listened very carefully to Dimitri's interview with Bill Godshall and Azim Chowdhury the other night. Shouldn't we be writing to OMB/OIRA also? They are not FDA and they are supposed to be on the side of small businesses. Wouldn't it be helpful if they could hear from us, vapers-customers, about what would happen to us and about the risks of creating a huge black market for e-cigarettes when/if the vaping industry is destroyed by the FDA draconian deeming regs?

Thanks!

If you guys have any suggestions as to what exactly to write, or other ideas wrt what to do now and whom to approach, your help will be greatly appreciated--either here or in the CASAA thread.

The holiday season is quickly approaching and I believe that we should act as soon as possible--before everybody gets distracted with food and families and shopping.

Thanks!

There are some good talking/writing points in the article itself IMO listed under Implications of the FDA's Regulatory Approach

I agree, but I was really hoping that CASAA would issue a CTA--wrt to the OMB/OIRA and in support of the Agricultural bill, as I suggested in my post linked above. 200K emails/letters might have a great impact at this point in the game--if we could get it organized.

Thx obg. Love the remark by one of the posters…

"..the real problem lies with the Tobacco Control Industry, which has turned science into witchcraft..."

"Vast exaggerations of likely harms, avoiding the timescales in which those harms could expect to cause illness or death, demonisation of the enjoyment of tobacco, persecution, stigmatisation and ghettoisation of smokers, etc, etc."

Good luck all.

Yo Mike! Or should I say Dr. Mike S. :)

Strong piece. Great work. Significantly helps to validate the authenticity of the TVECA released "leaked" documents. Thank you again Ray!

Tip: Read my post and extract on battery safety in mods which corrects your minor little miss and BTW, I also missed this the first time.

Well, there it is in black and white for those who haven't been able to come to grips with what is going on.

It's impossible to read that and not realize the danger the vaping industry faces.
Or should I say decimation.

This is nothing new to all of us who frequent this part of the forum.
Well, except one particular poster, who is finally gone now.
Deserves it's own thread....
And it should be a global thread.

And it should be a global thread.

And a global CTA--IMHO. It's now or never.

"I have made the decision to publish the commentary now because by the time the deeming regulations are released, it will be too late to change them."

"According to the OIRA web site:

"Outside parties may provide written comments to the OIRA Administrator on a rule that is under review. If a rule is at OIRA for review, interested parties can provide comments by email at OIRA_submission@omb.eop.gov. In the email please specify the name of the rule and the regulatory identification number (RIN) as specified in the docket for the rule on www.reginfo.gov.
Outside parties may also request a meeting with the Administrator, or his/her designee. If you would like to request a meeting to provide views on a rule being reviewed at OIRA, email: Mabel_E._Echols@omb.eop.gov or call 202-395-6880 to schedule."

The regulatory identification number (RIN) for the deeming regulations is 0910-AG38."
