I didn't... but I'm so ...... off right now isn't a good time for me to be writing anything, I had a dream we all did a vapers march up to the Big House itself last night, LOL

I would be totally for that too, if I could get money to go. I would definitely participate if we all showed up at our state capitals on the same day/time. I know that the FDA isn't controlled on a state level, but it would get the attention of the media to see 50 state capitals being demonstrated on at the same time.

My 20 year old great niece and her friends are smoking tobacco cigarettes, and not really interested in the E-cigs
(I tried to get them to switch).
I believe they've been smoking tobacco cigarettes since they were under-age.
If any government interference is needed, it is to enforce the ban on the sale of tobacco cigarettes (with the 4,000 carcinogens) to minors.
The rest of their efforts are unwelcome and not needed by
Free Americans!

Did I miss something or were electronic cigarettes not mentioned in the text of the proposed law? The gist of the law talks about names and specifically mentions naming tobacco and non-tobacco products with the name of a popular motorcycle that could attract young, under age buyers.

I went back and did a search for "electronic" and found only references to documents stored electronically, not ecigs. The only thing I could find was a prohibition of the use of product naming before 1995 being legal and one clause that said the FDA would exercise their discretion to allow certain products created before 2009 to continue to be sold.

I'm sure my favorite Camel juice named specifically that would have to be changed if the law required it to be trademarked prior to 1995. I'm surprised that some of the juice names haven't been challenged for infringement of trademark already.

ETA: Ok, I see the face-to-face sale prohibition in the text associated with the actual comment link. That is a problem for mail order suppliers.

I find the wording of this document vague in relation to the types of "tobacco products" regulated under the proposed law. Is it not already illegal to sell or purchase tobacco cigarettes through mail order or internet order?

I am an electronic cigarette user who has no brick and mortar store to buy from. All my electronic cigarette hardware and flavored liquids are obtained through mail order. If electronic cigarette products were not available through online order and mail delivery, I would have to drive approximately 3 hours one way to purchase supplies. This would likely make me revert to tobacco cigarettes until I could taper off and quit nicotine gradually. I DO NOT wish to return to tobacco cigarettes!

Electronic cigarettes provide nicotine without the high levels of carcinogens of tobacco. FDA studies have shown that nitrosamine and carcinogens approximately equal the low levels of Nicorette gum (about 8ng/ml), which is available at any drug store without prescription. I'm not sure I understand why the FDA seems adamant on its attack of the electronic cigarette industry. I'd think that the FDA would welcome a product that has no record of harm and reports a tobacco quit rate of over 80% through use as compared to prescription tobacco cessation products whose quit rate averages around 7% effectiveness.

Electronic cigarettes not only supply nicotine without the carcinogens of tobacco cigarettes, but also reinforce the feel of smoking through the hand to mouth habit that people trying to quit tobacco cigarettes miss the most. Electronic cigarettes are an effective and, in my opinion, a much safer transition from cigarettes to quitting altogether. You should test electronic cigarettes extensively and advise the public that they are a safer router to cessation, should you find and agree that they reduce the harm caused by tobacco.

I asked that very question and was told that e-cigs are lumped into it after the court decision declaring them a tobacco product rather than a medical delivery device.... which was the first battle fought by Blue et al.
And all kinds of vendors have had to change names of several juices like maxboro instead of marl...
Phillip morris bought several patents in2007-2009 range on the electronic side of things since previous models of big baccy companies have previously sucked bilge water, guess pm thought it was a win-win for them, not sure why they aren't chiming in yet.

I humbly suggest that in such cases using fax is probably more effective. It's much easier to sidestep (and delete) electronic-only messages than to ignore a pile of printouts. Think about the impression that a pile on the floor and the machine beeping for additional reams of paper makes when they come in in the morning ;-) A whole carton of paper is needed to print 5000 single page messages!

I submitted a comment. Wish I would have copied it to paste it here. But I basically said:

There is no reason to ban the sales of such products online when there are creative solutions that can be put in place.

For instance there are flash based video recorder that can be placed on a website that will activate the customers webcam, allowing them to record a short video holding up their government issued picture id and saying a line to confirm they are age 18 or over. These records could be maintained in the customers account and the video can be referenced every time they make an online purchase at that website. These records could also be uptained by the government upon request should there be a dispute. This is far better evidence than even face to face sales and such video records could be mandated by government for these types of online retailers.

Since these are flash based recorders that record on demand and do not accept a pre-recorded uploaded video, there is no way to forge such a video.

This is a far better solution than putting a lot of people out of business.

I never thought of it that way before.
I think I may have to go out and buy a fax machine!
