My first inquiry would be to specifically define a medical device and ask under what definition it would fit under? If it doesn't fall within the set of regulatory definitions (which it does NOT), is the protocol to return it to the importer? The situation isn't logical, if a small staff at HC is bombarded by `suspected` medical devices, wouldn't it make sense for Customs to be certain or more familiar with the definition? Anyway, thanks for sharing what you have encountered thus far, it is sadly interesting and informative.

HC definition of a medical device:

Device (as set out in the Act): means any article, instrument, apparatus or contrivance, including any component, part or accessory thereof, manufactured, sold or represented for use in

the diagnosis, treatment, mitigation or prevention of a disease, disorder or abnormal physical state, or its symptoms, in human beings or animals,
restoring, correcting or modifying a body function or the body structure of human beings or animals,
the diagnosis of pregnancy in human beings or animals, or the care of human beings or animals during pregnancy and at and after birth of the offspring, including care of the offspring, and includes a contraceptive device but does not include a drug.

As part of my job, I have to check websites to determine what category a given company should be placed in. I'm not an industry expert by any means, I work off keywords and phrases I've been given. So my guess is that the customs inspectors are doing roughly the same thing: they are not themselves experts in medical equipment, and a lot of medical equipment looks like nothing on earth, so likely enough the word "surgical" raised the flag, and the item would be then passed off to actual experienced persons to decide what it is in terms of import law.

I think you're on the home stretch.

Years ago on New Years Eve my friend cut his finger. Just needed a couple stitches but you can guess how long the wait would be in the emergancy to have that done. So while drinking from a bottle of Jack Danials his girl friends mother stitched his finger up with a sewing needle and some thread.

Are importing sewing needles consider a medical device now?

You're right Pericat either way I'm on the home stretch. If they release it I'be vaping happily soon and if they send it back we go to war.

I think you will get it. Just a bunch of red tape!!
