So I was smoking on the sidewalk, not owned by university of Kentucky. I was talking to a man about to have a tracheotomy about my ecig. He was
Mind blow that it was smoke free. A security officer came up and said "put
That .... out". I relied it was an ecig and the no smoking sign on their property says no cigs no dip. He said tough .... and said to put it out.
Well you guys know you can't put out an ecig. So he the. Proceeds to apprehend my ecig, and I notice that in his pocket is nicotine gum. At this point I'm ....... I point out that his gum is a tobacco product by his fascist definition, and he slammed his window. I finally got my ecig back by another guard who was more sympathetic.
My question, university of ky has
A no tobacco rule. Is this enforceable on a public sidewalk with my ecig? What do I do next time, because I spend 5 hours a day on their property with a client I drive to radiation. Do I have any ground here or should I just bathroom vape and move on?

Wow! If it's a public sidewalk I cannot for the life of me see how some 2-bit private hire security guard has the authority to harass and ultimately steal the property of a member of the public. It sounds ludicrous and I would certainly take it further. If Ky does have a "no smoking anywhere" law of some kind in place, and a private hire jumps out of the damn woodwork and plays cop anyway, that's impersonating a police officer to my mind.

If the sidewalk is next to a public road it should be public property. If the sidewalk is next to a private parking lot or road it could be private property.
It's hard to say without being there to see the layout.

Don't be so sure that a university officer is a 2 bit private security guard. The local university here has their own police department. They're often 2 bit cop failures but they have all the powers of a real cop short of having a jail to throw you in.

This local seems to be set up much like UoK according to their map where some streets running through the campus are public and some are private.
But if you want to get technical it's all public property since it's a state university, which doesn't apply to the local because it's private.
