I would be going over the employee manual with a fine-toothed comb regarding termination reasons. Are they required to give you any kind of notice or warning? Do you have employment standards branches that you can utilize for redress? Employee rights organizations? Have you done anything that your boss would look for any excuse to terminate you?

As far as I know you can't be fired for just "offending someone". If that were so, nobody would be holding jobs for longer than a week.
I'm a little late to the thread, but you actually can be fired for offending someone,. Or for any other reason actually.

Hell, there was an employer in Ohio a few years ago who gave everyone in his building a year to quit smoking and after the end of the year fired everyone who still smoked.

There are few protections for workers outside of unions and employee contracts.

Sorry to hear about you losing your job. I know vaping isn't smoking, that being said I try to use common sense when it comes to vaping. If I am not sure that it is allowed at said place I am at I will ask. If not then I will step outside, find a bathroom or dark corner where no one will see me. And no, I do not stealth VAPE. No matter how good you think you are at stealth vaping you can bet either a little bit of vapor will escape or someone who is ignorant to the whole vaping thing will see you doing it. No matter what you do, there will always be people afraid of vaping just like they were of smoking, they will never understand it until the FDA, government, or someone else can prove that it is 100% safe. Good luck on the job search! I vape at my desk here at work... I'm in sales so I just hit the phones all day, my boss loves that I vape instead of smoke...

He would much rather have me vaping and work a full shift, rather than smoking and taking 5 small breaks per day.

Look for a better job, ask if they have an issue with ecigs before you get hired. Protect yourself.

The lesson I would take from this is to not honestly answer the office busy bodies questions when they ask. It's non of their business, just tell them you were'nt doing anything, hide your ecig, and deny any inquirys from the boss. Then of course find out the actual policy and stop using your ecig on the premises if necessary. Being fired for this kind of thing is ludicrous, it's not a wonder why some people get fired and return to do bad things when screwed over in this manner. It's also a good bet that those who would narc you out are the HVPTA types, I wonder if they have any office supplies at home.

Dude that's bull. Vaping is not smoking and if I were you I would immediately take that case to a lawyer..simply to stand up for the vaping community ! We were penalized by the world for smoking..so we find this new world of vaping ..and now they want to take that freedom from us..and it's healthy for gods sake! Apply for unemployment benefits asap. Take advantage of the money you are putting into Uc every pay check.

PA is an at-will state as well and it's terrible. I do not understand the benefit for the employee to work in an at-will state. Makes no sense to me, but what do i know. Next time, just ask the people around you if they know what an ecig is and if they would care if you used it. Worse comes to worse, you have to walk outside and use it. Still better than smoking a real cigarette.
