Yeah I too think everybody misunderstood what happened to the OP. Asked to stop vaping, politely puts PV away, pays tab and tries to go home. Soon as OP gets in their vehicle a cop starts harassing him, obviously fishing for SOME reason he can screw with fanatic. That's BS in my opinion, you were just minding your own business, get told to quit the vaping, and then when you say "Ok sure" and try to leave, they harass you for that. Can you blame the OP for getting upset? I know I sure would if people were just harassing me because they didn't understand my vaping habit...

I think some of us responded to the general tone of the post without reading it fully.I know I did and I apologize for that.

I would contact the police officers superior and have a few words with them either in person or over the phone and causally mention having contacted an attorney in case this ever happens again.

Id also mention that you were well within your rights to be using a PV in public and dont appreciate what you perceive as harassment.

Jr bob wasnt carrying in bar i have a few firearms manufacturers stickers on my truck so the moonlighting cop asked if i had weapons responded yes .

I wasnt the least bit upset being asked to stop vaping. How the LEO treated me was what got me fuming. He sure didnt like it when his on duty buddy pulled up and i say hey those people smoking by the front door arent 8feet away from the entrance they need a 25dollar first offense ticket. Oh should of seen the look on the off duty guys face when i said that.

My own opinion is that, if there is a smoking area, I should use it for vaping and not vape in the bar or main areas. If smokers have to go outside, then I go outside to vape. Like I said, that's my own opinion.

actually .. I stealth vape wherever I want/can . .but as far as open vaping, I follow the rules for smokers.

I think the OP could've avoided all this if he had done that . . .but, from the sound of it, it was pretty ridiculous to get confronted by cops in the parking lot if all you've done is politely stop vaping when asked. They wouldn't jump a smoker who smoked inside.

That's why I'm a member of a private club that allows smoking. So I can use my E-cig without worries. I tell you now thou. That place really stinks to be sense I quit smoking. I walked in for the first time in months and I quit about 6 weeks ago. I just got about knock on my .... because of how bad it smelled because of the cigarette smell. To think it never bothered me till now.

See, I don't completely agree with that. IF the OP had already cleared it with the proprietors, then vape away but be prepared to constructively educate anyone who questions whats going on and, make darn sure the bartenders have your back. If not, then yeah, it's go outside or ninja time. Keep in mind though, being sneaky is suspicious in itself as well. Was the cop was rude, harsh, yelling, cursing or just being a smug @**hole and asking questions. It's their job to question suspicious activity, but, to do it politely and any of the above would certainly get reported. But only after respectively dealing with the immediate situation spouting a great deal of yes sir, no sir's and not escalating it. Vaping on a mod may not be suspicious to us, but it sure is to the general public which is why we need to do more of it openly in more places that are OK with it. I'm the only one in my city I've ever seen with anything larger than an 808 in hand. Not only do mods bear great resemblance to certain "tobacco novelties" it can, and frequently is, used for the same products.( see my above post) Some members keep some cig-alikes with blue LED's for public use because they're more well known as e-cigs and tend to raise less problems. I personally vape my Provari everywhere it's allowed, but am prepared to be asked ... is that:)

Some people have complained about the way they've been modded on ECF. They get all irate and start talking about their *rights*.

BTW, has ANYONE considered that the cop thing had nothing to do with vaping??

These days, you leave a bar, and get into a motor vehicle, you are at risk for being pulled by a cop. That is because drunk driving is illegal. They don't know you're not drunk so they investigate. That's reality these days. One of my friends, an older woman nicely comported and a grandmother, just left a nice restaurant recently and walked to her car in the municipal lot. She had not made it out of the lot when approached by police. She was breathalized, and arrested. She was like at the minimum you could possibly be at, but nevertheless, over the limit. She had met some coworkers for a holiday drink. (she NEVER drinks except at holiday parties like once a year!). But, she lost her license, had to go to court, and now has a breathalizer in the car or it stops running unless she puffs into it every 30 minutes.

I felt bad for her, she is a good friend, but she should have had more sense to call a cab.

You call attention to yourself in a bar, when you leave, expect to be looked at. And pray you pass a breathalizer. :) In her case, she is good looking, so she was probably noticed just walking to her car. :p

Ok,

First rule to remember, when out in a public establishment you are a guest on someone’s property. This does not elicit any self-entitled rights...also if a no smoking policy has been put in place then I'd observe it even with vaping until I could ask politely if I could vape in said establishment (assumptions makes an ... out of you and me as my dad always said).
In the event that you are asked to leave or told that you can’t vape at said location, there is no laws that will protect you to vape in that establishment. If it is a rule then you must follow it even if you don't think it is right, to not do so can land you harassment or even jail time. Remember that you share the same air space as several other people, give respect as you would want it in return back.
Worse case is you end up outside, you can still vape and not draw unwanted negative attention to yourself. Everyone is happy and still can have a good time; if you are unhappy about said rules then freedom of choice allows that you don't return to that establishment.
Remember that vaping is new, not everyone knows about it nor cares. We are the stewards for this and to leave a positive impact that will last a lifetime is the goal of most people. I myself have been asked to leave on account of one of the patrons is bothered at an establishment, I do so without any negative feelings as I realize what if I were in that persons shoes. More often than not nothing comes of it and the day moves on without incident, every now and then I get questions on what an E-Cig is and I can educate the person asking at that point to shed a positive light on it.

The classy thing to do would have been to pay your tab, give the bartender a huge, fat tip and tell them good luck and goodbye. The next day I would be calling all the local bars asking if they allow ECigs, and if one says yes, that is your new hangout, then post them on this Forum as being a vape friendly establishment for your area. Always drive with your mod in plain sight and at least keep your business cards from the retailers on you. I don't worry so much about cig alikes, people are more accustomed to those.

Ok in birmingham AL Ecigs are exempt from smoking bans(they almost banned ecigs in public). Being told by a off duty cop i am breaking the Bham smoking ordinance is what got me. I had no problem when they told me i could not vape. Had been playing pool and buying some friends shots, after i was told i cant vape i closed my tab and went to truck. What got me was the very sec i put my key in the ignition the cop hit the flashlight. I know what he was thinking going to get him for DUI.

My problem is after showing my CCW permit and taking a sobrity test they pop the any drug questions. Basically the cop was trying to find a reason to give me a ticket or take me to jail.

Doesnt take much to see i was harrased if they would of just left me be id be fine and never set foot back there again.

Call his supervisor and complain. Keep him on the phone for about ten minutes and tell him what you think about this and then call the city attorney and do the same. Wait a few days and call them back. Callthe bar and let them know why you won't be comming back and when you find a new bar make it clear that you are looking for a new regular place to go where you can vape and tell them all arbout your experience at the other bar. You'd be surprised at how fast word gets around.Let everybody know there is some bad blood between you and some other folks in town. They'll wish they had left you alone- which is what you want.
