I would deffinately go to the police station keeepign Chuckdragons's advice in mind. Police get yelled at all the time from people in the wrong. Thsi time the cop is in the wrong but staying calm and taking the opportunity to inform LE what the e-cig is should help you far more than going in angry.

I am a dog trainer and train with a lot police officers. I do use my e-cig in front of these officers who know me and use the time to educate them on the e-cigs and vaping. Good luck.
 
As someone who works with cops, don't waste your time talking to whoever you can get a hold of with the highest rank; ask specifically to speak with Internal Affairs. Every department should have an IA office. Be prepared to file a formal complaint against the officer. If you do that, you may even have a chance to speak with his honest-to-goodness actual supervisor and resolve things relatively easily, with no fuss.

I totally agree with everyone here, get your stuff back asap, but keep the .....ing and flaming on the forums. Yelling hardly ever gets done what you want, the suggestion to ask to file a formal complaint also sounds very solid, it makes the point that you aren't just there to give them crap and you intend to do what you came for. The officer had no right to take anything from your car what-so-ever, and in the future I wouldn't let them. At the very least they have to prove that you're using something illegal (I do believe), and if nothing else at least give a receipt for property taken. If the officer refuses to give you a receipt I would call 911 and report it, the operator on the phone can contact the department to find out who has you pulled over and would probably be able to do something (though who know what)

I would love to know what town you were stopped in. It is law that each and every act that an officer performs on duty must be logged in the dispatchers log. Therefore, if he stopped you then there is record of it. If not, then an internal investigation needs to be conducted. I would simply go to that police station and request to speak with the Chief of Police and have a private and civil conversation with him, explaining exactly what happened and provide him with a list of each and every item the officer took. If you don't get any satisfaction, perhaps a call to the states Attorney General's office may be in order to file a formal complaint. They have got to show you in writing that what he took from you is listed as illegal to possess, which we know they are not.

Several months ago I went and actually showed my chief (a good friend) my PV and explained it to him and also informed him that he and his crew may see more of them around in the future so be aware.

Do whatever you have to do, but you are entitled to get your items returned with an apology in my opinion.

Illegal confiscation of property is theft. Go to the station and demand it back , then talk to an attorney. Police cannot confiscate property just because they dont know what it is!

WTF is up with your state?

You can't just confiscate personal property without a law backing the seizure.

Go to the cop shack imediately and get your gear. If they can't find any dope associated with your gear, it's considered CLEAN.
 
Lawyer,then Internal affairs,maybe even a lawsuit. As long as there legal where you are.


I disagree (slightly)....

I'd consider the local desk folks first....with Internal Affairs my next stop if needed (and maybe just to drop in, say hi, and give them a polite rundown).

If that doesn't work, then bring in the lawyer and lawsuit, if its worth time time, effort, and energy to you. I'd like to be able to be all self-righteous and tell you that you need to take it to a court, etc....but really that's a call only you can make.

Honestly, to you personally, the lawsuit and all really probably isn't worth the headache. But hey, if you can do it, do it!

Let's see if I have this right, he took all of your e-cigs, because he "didn't know what it is, so he needed to take it"? It sounds to me like he may be a crooked cop who is using his badge to do some stealing.

I hope you got his badge number. Go to the Police Station and file a complaint against him. You may not be the first person to do so.

Super post, shortstuff, I agree, she should give the Chief some time line and manner of stop just to see if the stop was called in. Illusion of Impropriety if it wasn't. Blatant theft if it wasn't turned in to evidence. Someone's badge should melt over this. I hate this kind of stuff, my husband and I were both officers of the "old School" era. Things are different now, I know that, especially in a college town, but internal pressure should require honesty and integrity to the utmost. She should find a kind ear from the Chief, I would hope!! One more citizen complaint sure can't hurt if some heads need to roll.

I had to come here and vent to someone who understands how ...... off I am after what happened today.....so here it is.

I got pulled over today and the cop took my PV/carts/atty/extra batteries saying that he wasn't sure what it was and needed to take it. What pisses me off is that I have nothing now. I need to order something, but not even sure it's worth the hassle. I told him that they should be educated on this stuff instead of just taking things for no good reason. He didn't love that idea so much....

I'm actually really really ...... off, because it took me so long to quit, and I finally did the DAY I started vaping (2 weeks ago), now I'm back to the analogs because of this nonsense. What's even worse is that I got this thing 3 days ago in the mail.

At least I still have my car charger....joke's on him, eh? :(

What the heck were you pulled over for? He can't just seize your stuff. This is the USA and you do have constitutional rights

Just my two cents as an old guy.

First stay calm, it won't do you any good to go in there threatening the police department. You will get more with honey than you will with vinegar.

Second, do your homework. Look at this as a golden opportunity to educate the police department. It may help others who have turned to vaping instead of smoking cigarettes. Print out some of the information from the EFC and if you can bring in copies of your receipts it would be beneficial. Most police officers are pretty smart and look forward to learning anything new that would make their jobs easier. If you own a laptop or they would let you use one of their computers, log on to the EFC website and show them what vaping is all about. You could also show them the websites where you purchased your vaping supplies.

Give this a try and let us know how it went. Remember that we are all in this together and you have many people who can help.

I agree completely. If you go in and say "That #$%#%$ cop took my e-cigarette and he had no $&#%$ right to do it" they're going to get defensive and you are going to have a fight on your hands.

Start nice. Go in and say "I was at such-and-such place at this time when I was pulled over by Officer X. He didn't know what my electronic cigarette was and he confiscated it. While I think he was wrong to do that, I realize they are a fairly new product so I brought some literature with me to educate the members of the police force because they are becoming more popular every day and you will be seeing more of them in the future. I would like to have my electronic cigarette returned to me."

If they say "no," then you tell them you will be taking it to Internal Affairs, and further if need be. With the help of your e-cigarette, a legal device, you had finally quit using tobacco and the officer's actions have resulting in your smoking again.
