I agree completely. If you go in and say "That #$%#%$ cop took my e-cigarette and he had no $&#%$ right to do it" they're going to get defensive and you are going to have a fight on your hands.

Start nice. Go in and say "I was at such-and-such place at this time when I was pulled over by Officer X. He didn't know what my electronic cigarette was and he confiscated it. While I think he was wrong to do that, I realize they are a fairly new product so I brought some literature with me to educate the members of the police force because they are becoming more popular every day and you will be seeing more of them in the future. I would like to have my electronic cigarette returned to me."

If they say "no," then you tell them you will be taking it to Internal Affairs, and further if need be. With the help of your e-cigarette, a legal device, you had finally quit using tobacco and the officer's actions have resulting in your smoking again.

Finally someone with a shred of common sense. LOL, you all sound like a bunch of kids puffing your chests out in the pool hall saying "I would have done this if that happened to me. They know better than to mess with me" ... Get real. and if you're actually goaded into doing something like that you're probably the one that's going to get hit with a knee-knocker. You could lawyer up for about $600 or a thousand(although an honest lawyer wouldn't steal your money) and the lawyer could go down there and pick it up for you. No, you're not going to be the next Rodney King. I'll wager the cop is perfectly within his rights. You may or may not get your stuff back. Hopefully (very probably) their procedure bags and tags it and it gets filed in the confiscated evidence room. It's probably on you to go retrieve it. They're not likely to test it and send a community affairs officer to your house to return it with an apology and a gift card to Starbucks for your inconvenience.

LOL, you will get it back (more than likely). You will have to go down to get it. You will probably have to file some form(s) and you may have to go back a second time to pick up the merchandise.

I had to come here and vent to someone who understands how ...... off I am after what happened today.....so here it is.

I got pulled over today and the cop took my PV/carts/atty/extra batteries saying that he wasn't sure what it was and needed to take it. What pisses me off is that I have nothing now. I need to order something, but not even sure it's worth the hassle. I told him that they should be educated on this stuff instead of just taking things for no good reason. He didn't love that idea so much....

I'm actually really really ...... off, because it took me so long to quit, and I finally did the DAY I started vaping (2 weeks ago), now I'm back to the analogs because of this nonsense. What's even worse is that I got this thing 3 days ago in the mail.

At least I still have my car charger....joke's on him, eh? :(

I would have told him he could not have it. If he insisted I would say he would have to arrest me and without grounds for the arrest (which there was none) I would tell him if he did choose to arrest me, my attorney would be filing a lawsuit against whatever county he works for (or the state, if it was a state police). I would NOT give up my e-cig for anyone PERIOD!

Hey, that's not nice! We have all been more than calm and sensible about this. Even the Terminator gave the guy a chance. He did!
But face it, some of these guys have an attitude. Knee-knocker? That only happens if they haven't been thru the temper management program. I have, but nobody takes my PV. We have to have some limits. You have to consider how dangerous it is to deprive someone of their addictions. Next thing, they'll be confiscating the coffee makers for heaven's sake.

And this thread is the proof of why the new liquids that taste and smell like ......... are a very bad idea. Cop takes one whiff of the inside of a car where someone is vaping that and they'll have just cause to do a complete search, etc.


Yeah! Cops don't like eliquid that smells like bacon...

I think its a great idea to educate them - saves THEM time and PV users headaches. Our units really don't resemble 'other things' when examined, so I'm sure your local cops would welcome anything that makes their job easier. Info sheets, a PV and juices in bottles (which they can test to their heart's content if they want) would be just the ticket (lol no pun) to save everyone from falling into this issue in future.
There is another thread around where one of our forum members got pulled over for something unrelated and while ONE cop was suspicious his partner, who knew all about PVs / e-cigs soon put him right and explained about what they were; leaving cop #1 rather embarrassed.
I do hope the OP gets this sorted out in a friendly and non confrontational manner; people do make mistakes, this cop may have made a HUGE one from the sounds of it, but perhaps his colleagues are more gadget savvy.

I'm now considering DIYing some jelly donut with powdered sugar e-liquid. If they smelled that in the car, they'd want a hit of it fo' sho!

Seriously though, I'm going to keep some literature on me after reading this. At least in my car. I usually try to hide what I'm doing while vaping in the car no matter whose driving next to me and bought all black gear on purpose to be nonchalant.

If it were me I'd lawyer up. Would be vaping on the city/county for at least a year.

Lord, it took a while to read all of the posts. Im a cop in TX, and know my state law, and what the supreme court says. Here is my statement and take it as you want to. This is not legal advise but only my suggestion.

Go get it back! Be polite, be informative, and be understanding.

I have stopped many people in my life and have found that any substance that can be used to smoke what ever can be heated, can be seen as Drug Paraphanila. I determine the fact it is Drug Paraphanila as to the if drugs are in the car, if there is an admitance of drug use, or if my nose/previous knowlidge leads me to believe it is Drug Paraphanila.

If a citation/ticket was given, get a lawyer! Officers cant just take something from you. If you feel that your rights where violated, GET A LAWYER! My department destroy's the paraphanila after a citation was issued. You may need to get a Lawyer to have the department to pay for the equipment. It sounds like the cop was either new (not alot to base his decision on taking the items from you and not issuing a citation) or an idot (violating civil rights because he didnt want to admit, at the time of the traffic stop, that he was wrong.)

I have made traffic stops on "reasonable suspicion" based on the fact that any reasonable person believed that a crime was being committed (drug paraphanila being used to smoke drugs). Once I determined that the crime was not being committed, my investigation ceased, and I sent them on their way with an explanation and an apology.

Now as to E-cigs being used as drug paraphanila, I have issued 2 citations for that offense. I dont remember the brand (god I wish I remember) but I located ......... inside the device (one bad apple spoils it for all of us). I would not have issued the citation if ......... had not been located, just like if I found a glass pipe and no ......... was located inside it. Both times, I confinscated the items and used them at the time of trial.

If anyone has any questions as to Police releated questions, feel free to PM me. I have started a group called "The Thin Blue Line" in the groups forum and Ill see if I can find a police officer in your state and have them PM you with an answer.

Some of them may well have an attitude. But they got the guns and they have the cuffs and they don't care (especially the ones with the attitude and even more so after you give them attitude) if you spend the night in jail. And I don't know what TV lawyer show these guys have been living in but you're not going to get Perry Mason to get you a million dollar civil rights settlement on this one. Best case with a lawyer is that you spend $500 to get your $50 e-cig kit back (which you could just go and do yourself). ...and...puff puff, hahahaha, puff puff, hahahaha, someone said that the cop just might be using his badge to steal?... $50 e-cigarettes one at a time?... ahahahahahaha. sorry, I lost it. *ahem* yes, that's a distinct possibility. You should probably have the attorneys general office or some investigative branch at the state level look into that one. I wouldn't take it to the station because the entire department might be in on something like that.
