Wiz, the way I understand it, e-cigs will be regulated the same as cigars and pipe tobacco, not cigarettes. This may be subject to change, but at least for now, that's the way it appears to be.
That would be a good scenario Jerry. It would not fall subject to PACT in that case.

Don't worry about withdrawl, guys. I'm sure we will very soon be starting an FDA watchdog thread to keep tabs on regulations the FDA will be trying to sneak in. We still need to fight for reduced harm/modified risk status and watch out for attempted regulation of bottled liquids, non-tobacco flavors, nicotine strengths, indoor use bans and unreasonable taxation on both the federal and state levels!
And the beat goes on! Kristen.......My thanks to you for all you have done and continue to do. That is a long watch list.

This is a little off topic so I apologize in advance. As an extremely grateful e-cig user and proud member of CASAA I just wanted to congratulate everyone on our victory and extend my sincere appreciation: First, to the outstanding and tenacious legal team representing Sottera - you people are the absolute best, what an amazing victory, especially considering the odds and the current anti-tobacco/smoking climate; next, to the exceptional board members of CASAA - Kristin, Elaine, Thad, Ron, Villa, Dr. Whit (I know I'm forgetting some people-sorry), your tireless and persistent efforts on our behalf have gone so much farther than above and beyond and it speaks to the character of each of you; also thanks to Drs. Michael Siegel, Joel Nitzken, and Brad Radu for giving so freely and enthusiastically your expertise and support of this technology, as well as Bill Godshall who also has fought and continues to fight tirelessly for the cause - though Bill and I disagree on some things, on this thing we certainly agree and I appreciate greatly all his efforts on our behalf; and finally to every member of CASAA and everyone who posts on ECF as well as the board of ECF for providing and efficiently managing the forum - every person who has written lawmakers, posted comments, researched and posted pertinent links so the rest of us could learn and remain abreast of the technology and the science; Sun and Julie who very ably and cheerfully kept each one of us up to date on this important legal battle; every person who posted and so willingly shared their thoughts and feelings and graciously helped newcomers and contributed to our ability to feel solidarity and persevere. I am very grateful and proud to be a CASAA member and a participant on the ECF forum - I can think of no better class of people with whom to associate - Thank YOU ALL!

I second all of that! I could not have said it any better. Thank you SunVapor & JustJulie and all the others!

How very true that is, Kristin. The fight is far from over.

Sorry so late . . . been swamped today.

A status report was filed in the TW v. FDA case saying that the parties are in discussions, and a report is expected by be filed on or before May 13.

I expect the FDA is reviewing documentation provided by TW to determine whether or not TW is making therapeutic claims. :)

Glad you posted so we didn't have time to miss you. :)

Jerry....I wish I had more time believe me. If my kids were older and needed less supervision I would definitely be more of an activist for e-smoker rights. I really do regret that I don't do my part. Maybe someday I can be a test subject for the positive effects of long term vaping or something.

I sure am thankful for all those like JJ who keep fighting the good fight for dummies like me:)

Thephoenix, they may well begin to "propose" e-cig regulations in "the coming weeks", but that certainly does not translate into taking effect. All proposed administrative regulations must be subject to public comment periods, and a whole process culminating in publication in the federal registry, before ultimatlely being formally promulgated. This should indeed take up to two years. Even if they try to "fast-track" e-cig regulations, I'd be completely amazed if anything was finalized before at least a year.

I agree Jerry. From what I have read on all this so far leads me to believe that e-cigs and liquid will be left alone as long as vendors do not advertise them as smoking cessation products.

Does this sound right? No mention anywhere on flavors being banned as far as I have read.
