Dear valued customers,

I'm sure you have heard about PACT ACT and all its new requirements to ship any vape related products by now. We are determined to put in our greatest effort to continue our business and serve our awesome customers and is preparing all the necessary paper work for each state. With the PACT Act in effect, we will only be able to ship to limited States at the moment (Please see list below), but we are working hard to hopefully expanding the list in the coming weeks or months and we will update you when we'll be able to ship to more states. If you do not live in these states but have friends or families that do, we greatly suggest to ship your order to them as per United States Postal Service, lightweight shipments mailed between adult individuals, limited to 10 per 30-day period, is exempted from PACT Act.

STATES that we can still ship orders to:

Texas
Arizona
Florida
Michigan
Mississippi
North Dakota
Oklahoma
South Carolina
South Dakota
Tennessee

Please note that all orders now will required adult signature upon delivery and a fee of $6.95 will be added with the shipping cost at checkout.

We greatly appreciate your patience and understanding as we work through this difficult time and we will keep you posted on any new information.

Sincerely,

VapoRider

"Some big updates happened over the weekend and I just wanted to keep you updated. On March 27th we were contacted by our lawyers saying that USPS had officially made a statement around the vapor ban. It essentially said that they had pushed back their decision making timeline until April 26th. I don't have a ton more details outside that, but that means we're allowed to sell vapor products until April 26th now. (Full details on the ban HERE)

Hopefully it just keeps getting pushed back *cough* FOREVER *cough* but we'll see.

Thank you for sticking with us through all this!

Have a great day,

Sam

I'm so worried about trusting a vendor on this we have heard so many different things, not sure how one lawyer would be privy to info everyone is waiting to be announced. If USPS has decided this why don't they post it? Almost a moot point now considering most online b2c have shut down already.

I haven't seen anything "official" from USPS yet--I keep checking the source. Their lawyers know something we don't?

I don't think many vendors know what is going on.
Have read about the April 26 date before tho.

The thing is too the PACT ACT went into effect on the 27th so even if they delay the shipping ban date till then there are shipping price increases, adult signatures required and reporting your buys to the government to contend with.

Yes, this is why so many have decided not to ship at all. The actual date of the USPS mail ban is one thing, but having to meet the requirements of PACT Act isn't worth it to many (or they dropped the ball).

That's the first time I even seen a non-vape site even mention the ban, and, yet, even then, the article was written by a vaper. The rest of the world couldn't care less.

I placed an order for some drip tips with Kai's Virgin Vapor (a CA business) on Friday the 26th and the shipping was just 3 bucks USPS, no adult signature required, which surprised me (CA is an Adult Signature state.) But the order has not shipped yet. When I Visited the website, I found this announcement:

    "Kai's Virgin Vapor Blog

    5 Day Website Shut Down
    March 26, 2021

We are shutting down orders on our website for the first time in years in order to give us time to implement changes required by the PACT Act. The shut down will run March 27th through April 1st.

The PACT Act, also called the "vape mail ban," was enacted by Congress in December of 2020 and will ban the United States Postal Service (USPS) from shipping vape products, as well as burden vape businesses with complex registration and reporting requirements.

We are doing everything we can to lessen the impact of this anti-vaping legislation on our customers and have found a number of ways to reduce the burden this act would otherwise place on you. We will announce details soon!

In the meantime, don't panic! We are not in any danger of going out of business and the website will reopen on April 1st. You will continue to be able to place orders and receive them via USPS until April 26th. After that, we will continue to be able to ship to you using alternative carriers and will be offering additional help to get our customers through this transition.

    Together, we'll get through this!"

Sooo, am I going to get my drip tips or not?

Basically, if you don't sell anything between now and April 1st, you don't have to do your first PACT filling until May 10th, by which time any licenses you applied for should have been processed.

Aha! That explains it. Makes sense to me now. Thanks, Neil.

    And good luck!

    ^^This.

Beyond that, I can't say anything on USPS still shipping another 30 days (we've heard at least one liquid manufacturer saying their legal team told them the same and there's been chatter online, but we cannot confirm the legal team is correct.) CASAA hasn't heard anything about it through official channels and even if we had, we would tell business owners to speak to their own lawyers first. We would never give legal advice. But the PACT Act requirements are in effect, regardless of whether or not USPS has issued its final rule or is ignoring shipments of vapor products until it does.

I'd like to know where they're getting this information. I was just searching the USPS site and found no new issued statements. My e-liquid vendor is also under the impression they have another 30 days. It seems more like a rumor gone wild to me.

The problem is, even if the USPS isn't going to refuse shipments for another month, that doesn't mean the PACT Act rules aren't in effect and the ATF won't come after vendors for not getting signatures and/or collecting taxes for those shipments.

Of course, we are also seeing reports that some states are telling vendors who want to comply that they have nothing in place for them to comply with yet. And I suspect USPS has no clue what they are doing, either. It's essentially a huge clusterf#ck.

Seriously, if you ship vapor products, talk to your lawyer before believing anything you read online!
