This is complete crap two months ago i could light up and mess everyones lungs up and tonight im asked to stop vaping at a bar of all places. I mean cmon they went out of thier way to make a back porch for smokers then tell me at 3 am i am bothering their quest and i have to stop.vaping. seriously i am ...... off.

I go up to the armed security going ... i am within all our BS mandates for smoking and they look at ke like i am a drug addict

I respectalfully leave this establisyment since i know and have known the bartenders and owner for over ten years.

The armed and paid for.security(birmingham pd) tells me i am bothering guest and the owner ask me to stop so i abilige.

Now i have the so called armed gaurd(i have more ammo and guns than barrney fife knows what to do with) tells me i am breaking the law. So ok here is where i go ape .... and tell him i am within the statue of laws regaurding AL Birmingham smoking ordinance.


Well barney fife tells me i am breaking so and so law. Well here goes my ego i i say FU I am not breaking any laws and show me how and what law i am breaking(birmingham city orderence extempts E cigs) he gives me some bs speil. For two months i have been going to said EST and never had a isssue. So this evening I am bothering the.drunkards ( i saw two people.kicked out for violence last week welcomed with opem arms tonight) but yet i am vilified for staying within the law.


These sorry people want to put me in handcuffs and search me for illict drugs and give me a sobrity test, when ive only been drinkng pepsi.

I did nothing wrong and to have a hour of my time.taken up, physically molested strip.searchred and have my personal.property pillffered thru for no reason other than i look suspicisos.


I would think the 2k plus rounds and 5 guns woulb be more intresting than my two vaporizers

Not everyone is as receptive to ecigs as they should be, you can't force it down people's throats. You could have every right to be using it in a bar, but if someone asks me to stop, I'll usually gladly oblige. Worst case scenario, you end up outside with the smokers every once in awhile. It's not the "they had this, versus my two vaporizers", it's probably your reaction that got you in hot water.

It sucks, but with vaping being such a fine line these days you can't act like you're entitled.

Are you sure you didn't handle it in a way that would cause them to be suspicious? I've been around cops on MANY occasions with my mods and never even had a second look. I try my hardest when out at bars to not make it noticeable that I'm vaping and I almost never have an issue. I also think cops have a right to question any weapons on your person, if they're legal it should be a quick fix.

I suspect your emotions were a little out of control, which is why they harassed you maybe. I think you were a bit hot under the collar, yes?

When in a private establishment, I do as I am asked, as I know I'm a guest.

I agree with you about vaping of course, but still, if you are in an establishment that doesn't want you to do something, then best thing to do is politely stop vaping.

Not sure what having a lot of guns in your ownership has to do with any of this? You brought that up twice.

And by the way, nicotine is a drug. We are all addicted to nicotine, so we are addicts in that sense.

Was playing pool cutting up like always, then the owner and cop come up asi me to stop vaping i am like ok cool. So upon leaving the second my keys hit the ignition i get a facefull of maglite. The cop comes up asking me how much i had to drink. Being the smart ... that i am. you saw me have one beer over four hour period. Then i get the i smell alchahol on your breath so he calls in a on duty officer. In the meantime he ask me if i have and weapons or illeagal contraband in the vehicle. Well i tild him what weapons i had in car and he could search for illegal contraband allday long. Well a hour later they told me i was free to go after they tossed my truck

Sadly I doubt the owner would even be receptive to you contacting him and having the policy changed. Im all about standing up for our vaping rights but causing a scene shouldnt be among them.

The bar has the right to make any sort of policy they want to make. If they ask you to stop, you politely say, "of course". We were supposed to learn how to play well with others in kindergarten.

Or it might have been the fact that he let his emotions get in the way of his reason. Go back and read the OP.Im much less apt to speak to someone whos yelling, screaming and frothing at the mouth than I am someone whos rational,intelligent and well spoken.

As outspoken as I am about the subject, sometimes I find that speaking with my wallet is louder than words could ever be and I still maintain that calmly leaving and then contacting the owner and talkign to him face to face AFTER calming down would have produced better results.

I don't subscribe to the popular opinion of we have to roll over and be nice when people give us grief. You do not have to just take it every time someone decides you have to do this or do that. If more people would speak up and out the overbearing few would have a much harder time playing their games!
Why did the concerned off duty cop question you after you entered the truck? Why did he not say Mam are you ok to drive? Before you entered the vehicle? See the difference? We are so desensitized to harassment we don't even recognize it when its in our face!
I hope everyone who posted the OP deserved to be detained violated has the same happen to them then tell me how it feels!

Ok in birmingham AL Ecigs are exempt from smoking bans(they almost banned ecigs in public). Being told by a off duty cop i am breaking the Bham smoking ordinance is what got me. I had no problem when they told me i could not vape. Had been playing pool and buying some friends shots, after i was told i cant vape i closed my tab and went to truck. What got me was the very sec i put my key in the ignition the cop hit the flashlight. I know what he was thinking going to get him for DUI.

My problem is after showing my CCW permit and taking a sobrity test they pop the any drug questions. Basically the cop was trying to find a reason to give me a ticket or take me to jail.

Doesnt take much to see i was harrased if they would of just left me be id be fine and never set foot back there again.

I've been to places that have asked me to stop. I politely comply and leave. Probably never to return. I do the same with my pistol. If they have a sign on the door that says no guns my gun doesn't go in, but, neither do i. I'd rather spend my money somewhere else.

When I started vaping I made 2 lists using my 'foursquare app' to label virtually everywhere I go as either 'Electronic Cigarette Friendly' or 'Electronic Cigarette Unfriendly' in the Phoenix, AZ metro area. Most bars don't even blink at me when I start vaping and I've only had a few restaurants ask me to please 'be discreet'. As far as the legality of it I know that in AZ even if it's allowed the owner/manager can still say no to vaping in their establishment. If the owner's OK w/u vaping in the bar and the officer (offduty or not) isn't the worst he can do is write you a ticket which means that you will get to settle the matter in court. It could be a 'groundbreaking precedent' that could be used for years to come whether you win or lose.

I think you're all missing the part where the OP stated they politely quit vaping when asked to. It was the harassment outside when they closed out the tab and left that they're mad about. I'm not agreeing with the LEO, but, if you're gonna vape something other then a cig-alike, expect to answer a few questions at some point.( not to be harassed, just to answer questions) Some uses for the e-cig aren't legal in all states. This is why the mods drop the banhammer so heavily on references to certain things and plants as they don't want to be wrongly associated with those kind of activities. Google g e n t l e m a n s v a p e s( hope I broke that well enough to not upset the mods). I'm sure that stuff like that is getting around the LEO community pretty quickly. It sounds like a royal PIA but at least it got cleared up pretty quickly and without them confiscating your PV for further testing like I've heard at least one member say happened to them.

Yeah I too think everybody misunderstood what happened to the OP. Asked to stop vaping, politely puts PV away, pays tab and tries to go home. Soon as OP gets in their vehicle a cop starts harassing him, obviously fishing for SOME reason he can screw with fanatic. That's BS in my opinion, you were just minding your own business, get told to quit the vaping, and then when you say "Ok sure" and try to leave, they harass you for that. Can you blame the OP for getting upset? I know I sure would if people were just harassing me because they didn't understand my vaping habit...
