Look go down to the station.....they Can do a drug test then and there, which will determine there is nothing illegal in them..at which point the police officer took your personal property without cause, so you should get it back.

Agree. But...should I really have to go through the embarrassment of getting tested just to get back what is rightfully mine? I have nothing to hide...but can't they test the cartridge or something instead? I've watched "Cops" on TV before, and they have that liquid that turns blue if there's something bad, lol.

In any case, I am more calm now after reading everyone's replies. I just wanted a reality check to see if I should really have been as heated as I was/still kinda am about this whole thing.

Do yourself a favor and make a print out of the web page where you got your e-Cig and take your e-Mail order confirmation.

I know I'm going to get flamed for this, but, e-cig are not as comman in all areas as many people think.

I'm not saying the cop did right or wrong. Just saying that I could see how he does have probable cause to pull you over. And face it, they Can take what they consider drug parfinalia (SP?).

They will give it back to you, if you take in your paper work. It just is one big hassle that I'm sure you didn't need.

I know that nobody wants to hear it, but there are people using their e-cigs to deliver more than just nicotine.

This is going to be a bigger problem all the time. Cops should use common sense but quotas are still ruling the day. I know officially there are no quotas, but changing the name doesn't change the fact. A day in court still gets them overtime so it's a win, win for them.


I really can't suggest what tact to take for you. I have no idea what kind of situation you are in. I had a go around with the cops this weekend and I told them off at the bar (after trying to explain that vaping is not smoking) however, I am pretty secure in my town and know most of the cops on a first name basis.

Good luck and I hope you get your stuff back soon. In the mean time order a no box kit from Cignot. It's cheap they deliver super fast and no matter what it wont go to waste.

bsilverop - i'm sorry you had to go through that and i can understand your frustration. cops like that just ruin it for the ones who are actually out there to do good. i hope you do decide to go to the station and get your stuff back. i know it's such a PITA to have to explain everything to them, but hopefully it'll make them more aware that a lot of other people use these devices too.

Wow, That really blows. Where in Ma are ya? I sat right next to a town cop puffin on my silver eGo and nothing happened. Also had to stop on the highway and add coolant once and a statie stopped to see if I needed help and said nothing when I took a hit off my eGo. I'd be there DEMANDING they give it back immediately, citing illegal search and seizure (as previously mentioned), poised and ready to mention a lawyer if they try to keep it. If he took it because it "looks illegal" he should have given you an appearance ticket. I know I'd be furious if that happened to me.

Unless the people start standing up to this crap, we're going to have to used to it (and much worse things -- what if the cop had demanded a blood sample right then and there? Where's the line going to finally be drawn?)

You get right busy and go pick it back up!! Take a couple cards, if you have them, or just copy a page or two from the website you purchased it at and get going. Education time!! I can't believe any one could be so slow as to not know what it was. Did he give you a receipt?? He had no right to confiscate that without probable cause.....of which ignorance is not probable cause!!! If he didn't know what it was, even more reason to educate the guy, and anyone within ear shot. If he used the fact he saw you puffing on it for probable cause to make a stop, that's pretty poor judgement. He's going to be a laughing stock, believe me.
Take someone with you if possible. You're going to be really maaaad, need to keep your temper. ok?? Ask them if they would like a demonstration, and do a good job explaining why about 100,000 people in the US are using them, millions around the world! Show them a link to ECF for good measure. Nicotine is not a controlled substance.
Let us know what happens.

go get it back ! That was theft of your property. They took my sons walkie talkie because they thought he was involved in a crime. He wasn't. We went down to get it and it was gone. They never could find it and then later told us one of the police men must have took it home. It is theft. Don't let them steal from you, just because they are police.

Besides now they have it and you aren't there, whats to stop them from planting an illegal substance in it.

Just my two cents as an old guy.

First stay calm, it won't do you any good to go in there threatening the police department. You will get more with honey than you will with vinegar.

Second, do your homework. Look at this as a golden opportunity to educate the police department. It may help others who have turned to vaping instead of smoking cigarettes. Print out some of the information from the EFC and if you can bring in copies of your receipts it would be beneficial. Most police officers are pretty smart and look forward to learning anything new that would make their jobs easier. If you own a laptop or they would let you use one of their computers, log on to the EFC website and show them what vaping is all about. You could also show them the websites where you purchased your vaping supplies.

Give this a try and let us know how it went. Remember that we are all in this together and you have many people who can help.

As someone who works with cops, don't waste your time talking to whoever you can get a hold of with the highest rank; ask specifically to speak with Internal Affairs. Every department should have an IA office. Be prepared to file a formal complaint against the officer. If you do that, you may even have a chance to speak with his honest-to-goodness actual supervisor and resolve things relatively easily, with no fuss.

bsilverop: Did the officer give you his information? Did he inform you how you can retrive your property? I'm interested in the conversation and what he told you.

This thread brings up an interesting point. If the officer who "confiscated" bsilverop's property did so without a receipt of any kind - no ticket, no nothing - then at this point is is your word against his. (Guess which side the PD will take.)

So, if this happens to someone else I would suspect the proper thing would be to request a ticket of some sort which indicates the crime involved and the property being taken. You could also request a higher ranking officer to arrive on the scene.

I suppose one could also call 911 from their mobile and report that the police officer has taken your property, has not given you any sort of receipt for the property, and not given any infraction - so you're calling to report a theft of some sort. Ideally the officer would need to return to the scene with another officer and they can explain in more detail the proper process and you'll have some form of record they took your property and how to retrieve it.

I can fully understand them taking it IF they thought it was something illegal but it seems highly unusual to not give you any paperwork so you can reclaim it once they learn what it actually is.

Yeah, and people smoke pot out of apples.

That doesn't give the police the right to take your apples.

Was there no paperwork on the officers part? Did he give you any kind of document stating what he took, when he took it, etc? If you have no documentation, I would definitely report it as theft. This seems really strange.

Go to the station and demand it back! Wish you the best of luck and ease of getting it back.

On another note, most vendors send like a business card with all their shipments and on some of the cards it gives a short explanation of vaping. I know Vaporbomb's cards explain it a little bit. I would suggest just carrying around at least one card and if this incident ever happens again, just give the card to the officer, that way even if he does take the pv, then he at least has a website to go to for educating himself and others.

He still shouldn't have taken it without probable cause.

something else to think about since there was no paperwork done....maybe he's a smoker...just maybe he truly did know what it was but didn't want to do like alot of us did before we did our research and bought the $150 ecig from the mall.....my brother is a cop, my grandfather was chief of police in orlando for years and in williamston north carolina...so i have nothing against the police, but they are human, they aren't perfect and always "law abiding" themselves. maybe just maybe he wanted it to save him the money cuz all he knows of ecigs are the mall kiosks and radio commercials....just a thought... i agree with Kobudo...go talk to IA, not just the person at the front desk of the police department.
