I have a BA in criminal justice and this would be considered an illegal search and he stopped you for bogus reasons. All cops are to give you a receipt with reason for taking the said property along with their badge number. Look at any ticket and you will see a badge number. I also hear you doing a lot of complainning, and I understand, but unless you stand up for your rights then this cop will pull crap on others. He would have to put this in the evidance room, tag it with who it was taken from, when, time, location and such. If this is not in the evidance room then it was stolen from you. Wish you luck.

Actually, the stop is good. Reasonable suspicion gave the officer the stop. Reasonable Suspicion gives the stop; Probable cause gives the ticket or arrest. The receipt statement is correct, of course the receipt can come in the form of a ticket/citation. As for placing it in the evidence room, he is to follow department procedures. The department has the liability at that point.

As for the search, If the officer can articulate the probable cause for the search (the smell of brunt marij****), he can search the whole car. If the driver/owner gave consent, he has the whole car unless retracted.

By the way, a BA (which I have, working on a masters) does nothing if you don’t keep up with the rulings from the supreme court on a constant basis and implement them either on the street or in a court of law.

I know hopeless optimism can be really annoying ....... but ......... perhaps you could use the opportunity to inform some cops at the station about e-cigs. I believe everyone I know wants to quit analogs for obvious reasons. Would be fair to assume that there would be some smokers there.

Yea, im working on that. I have helped with the Officers in my department, but again they can be used for illegal activity (not very well by what I have witnessed).

And for the cop, the statement was unprofessional.

Yes it was unprofessional. He certainly could have said it a little more eloquently. Thinking about it after he said it though, I imagine it has a level of truth to it. Most people deal with the police after they have done something wrong. A speeding ticket is a great example. Instead of seeing someone doing their job they personalize it and just see a mean ol' cop ruining their day.

Those are the only ones people remember, and the rest get lumped into the same category. It's just basic human psychology. For example, I drive a truck. You see hundreds of trucks every day. Every now and then you run into a jerk, so everyone hates trucks.

(By the way, I love that commercial that shows how awesome the freeways would be if everything were shipped by train! Can you imagine how many railroad crossings there would be, if all the stores had rail-heads out back?! :lol: )

Yeah, but think about all the time we would have to drip, fill carts, or write novels while we wait for mile-long trains to lumber through the r.r. crossings at 10 mph. :laugh:

I had to come here and vent to someone who understands how ...... off I am after what happened today.....so here it is.

I got pulled over today and the cop took my PV/carts/atty/extra batteries saying that he wasn't sure what it was and needed to take it. What pisses me off is that I have nothing now. I need to order something, but not even sure it's worth the hassle. I told him that they should be educated on this stuff instead of just taking things for no good reason. He didn't love that idea so much....

I'm actually really really ...... off, because it took me so long to quit, and I finally did the DAY I started vaping (2 weeks ago), now I'm back to the analogs because of this nonsense. What's even worse is that I got this thing 3 days ago in the mail.

At least I still have my car charger....joke's on him, eh? :(

Wow, this really sucks. I just read this post, and I have to say, sadly, that I am not surprised. And it's sad that theft by police officers doesn't surprise me. However, before someone posts or pm's me about bashing police officers, just know that I come from a family of three officers, one a police chief till he died in Florida. And myself as well as everyone else in the world knows that there are good cops and bad cops. There are in any profession, good and bad people. It's just a fact. But since they are police officers, we hold them to a higher standard of morals and everything else. And maybe we should, who knows. But know this: there are police officers who will steal things from citizens. So if you think they won't just because the item doesn't cost much, think again. The really awful part of this is the poster is out his e-cig, and will probably get some cigarettes till a new one arrives. And may continue smoking them to not have to deal with this issue again. Being a relatively young male, he will undoubtedly see this happen again.

That said, I doubt you will see your unit again. Going to the station, probably a waste of time. The officers aren't going to go against one another, most employees won't do that either.

I would, however, be on the local news reporting about stolen property by a police officer. I would call every newspaper in town, every local magazine publication, and every radio station. You WILL find one that wants to share this story, just for the heck of it if nothing else. Maybe it will keep an officer from doing it again, or less of it. I would probably call the police chief too every day and for the rest of my life just to be annoying. Polite, but annoying, just for the feeling of revenge. Small though it may be. Sorry you lost your unit.

Did you receive a citation for anything? I didn't see it in the thread.

Ragamuffin, great idea! bsilverop would do well to check in with Kristin for a newsy press release, if she would need some great help.
Would be a great way to do two things, call attention to the seizure of her e-cig, and also inform the public with what e-cigs offer. And what they have meant to almost now 40,000 people who subscribe to ECF.
It takes a certain amount of finesse to be able to promote her story well and in the best possible light, but it can and should be done.

I agree on the last two statements. The most important thing is to FIGHT FOR YOU RIGHTS!

This brings me to another topic that i should probably post somewhere else.

But, you should vape in public! Now, if the business owner asks you to stop, so be it. But this device, IMO, should not be hidden! Educate....Educate....Educate! Or your just as much to blame for any type of ban the government sets upon you as the blame we place on them!

I'm sure a LOT of people saw what happened to me when I got pulled over by the cops while hitting my EGo. Pretty much absolutely NOTHING. Why? I think the fact that I'm FEMALE, I was driving a new car, had a child seat in the back, (not to mention my fearless Doberman Pinscher!) a Fire Department sticker in the window and, smoothy that I AM, I keep my Paramedic Badge in the same 'flip' portion of my wallet so that, when I show my driver's license, it all but BITES your hand, had a LOT to do with it.

In other words, I got lucky.

There was ANOTHER ECF member that was pulled over and had to sit in JAIL for 36 hours to get HIS mess sorted out. A LOT of how YOU'RE treated by the police, is how YOU treat THEM.

That being said, I have NO idea how the OP was with the cop. Some times, you just run into a Nazi. Go down to the station and GET YOUR PV BACK, it's YOUR property. Just use honey as opposed to vinegar.

Good luck. The newspapers will laugh at you. They can't afford the embarassment of trying to promote a (at best) petty issue. As for the poster with the 3 officers one of which was a police chief... bad blood in the family? Revenge? you got to be kidding. It was a stop. The cop had reasonable suspicion. I know it's unbelievable he wasn't intimately aware of our microcosm of ECF. Actually I'm ready to go to the labor board because not one single person in my company of 120 people has ever heard of an e-cig...

I really would love for you to hire a high powered lawyer and go after them. and go to all the newspapers and radio, and file a complaint with internal affairs. I'd love to hear how all that turns out.

Yeah that's funny I do practically the same thing to get out of speeding tickets :D,( thought I am not a girl I have beautiful blue eyes :D ) when I was in the military I always had my ID card conveniently with my DL :D

It is amazing what how effective the power of persuasion is when you go the positive route in trying to get your way.

I'm getting suspicious as to whether this is a true story. The OP is a new member, made a couple of posts then disappeared, wouldn't say what town this supposedly happened in. The story is also strange, stopped by a cop, took the e-cigs and drove off. No citation, no arrest. Just give me the e-cigs and goodbye?
