I hope so too, and that the amendment is just to strike section 18 completely. But I've said it before -- maybe even in this thread -- but registering with the FDA is not the same thing as getting approval from the FDA. I have no idea what is involved with registering, but it can be done. Johnson Creek did it.

Johnson Creek registered its laboratory that manufactures eliquid. Any lab that manufactures products for human consumption has to meet FDA standards for safety and purity.

There is no such thing as an FDA registration to be a vendor.

that registration & inspection was then used against them when cease & desist letters were sent out several months ago.

without guidelines from the FDA for eLiquid production, registration is meaningless.

Ah, yes. Thanks for making that distinction, Elaine. I'm not sure why I had that disconnect.

I didn't mean to imply that the possible amendment is a good thing. Quite the opposite, as a matter of fact. The point I was trying to make (rather poorly) is that for vendors who do have a lab and manufacture their own e-liquid, that particular amendment wouldn't necessarily be a death sentence for their business because they have something to register.

Actually, they were meeting the standards for a lab producing products for consumption. The FDA suddenly wanted to start holding them to the much higher standards required for pharmaceutical labs.

I just got word from Rep. Armstrong's office that he is currently "working with the Department of Revenue" on an amendment to HR 1729. Perhaps he has abandoned the idea of banning e-cigarettes in favor of taxation. I told his aide that it was very important the amendment be made public before Wednesday's meeting, she said it was a strong possibility it'd be done on Monday.

If this is going to turn into a minor bill / tax bill, I have strong doubts about the tax provision passing the very conservative Ag. Subcommittee.

I'll admit that I don't have much of a feel for Tennessee legislative climate, but I could see someone making the argument that we ought to be taxed like a tobacco product, which would probably mean we'd fall into a smokeless category at 6.6% of wholesale price, which I believe would be on top of a general sales tax, but I could be wrong.

I guess my question would be then, with most of us buying via the internet, how will they know when/how to tax us? I know the bill hasn't been drafted to its debatable form yet, so I may be jumping the gun, but the only logic I see here, if collecting money is the issue, taxation of products bought openly in TN- like Kiosks and Pilot gas stations. Funny side note on that- Haslam, our new governor is the owner of Pilot oil- the same places that started selling e-cigs last year...LOL

Based on what I have seen on other (non vaping) sites, a tax would probably be levied against TN residents. For example, a lot of places I buy online have statements like "CA residents add xx% sales tax". I browsed a snus site once (can't remember which one) that had a tax rate table of how much tax would be added to your total based on your state.

The meeting is tomorrow.

Rep Armstrong's aide told me on Friday that we'd likely have the amendment on Monday morning. It's Tuesday afternoon and it hasn't been finalized yet, and the lobbyist that Rep. Armstrong has had reach out to me has stopped returning my phone calls. We're not going to get the amendment until right before the hearing, if we get it at all.

I put in calls to the offices for all the legislators warning them of the possibility of a tax amendment, and encouraging them to vote against it. Considering that this is the same committee that declined to raise the fine for cockfighting from $25 or $50 to $500, I don't think the Republicans on the Committee are big fans of taxes. Moreover, the legislative aide to one of the Democrats on the committee actually uses an e-cigarette, and she seems to have swayed her boss to vote against the bill.

This is the last meeting of Ag. Subcommittee of the the session apparently, so if it doesn't pass tomorrow, it's likely dead.

I just wish I knew what I was fighting for Julie!!! lol

I still have everything prepared from last week. If section 18 has been amended, I'll throw that out, thank the Committee and even Sen Armstrong, and sit back down. If a tax amendment or something like it is added, I'll have to quickly act on my feet. Lets hope I don't get nervous and start humming the Star Spangled Banner or something ;) LOL
