I cannot post anymore in this thread according to ECF rules.

I have had my say on this matter and will conduct all further communications with Ike in private.

Thanks.

No, you want to come on and settle this, we can do it as gentlemen. If these "Rules' are in the way and if I have dictatorship of them in my forum. I grant you full permission.

Well I have had a warning so unless you can override that...

All of the products you show in your previous post look nothing like the Mako externally.... design protection covers the way a product looks on the outside and unfortunately your prototype so far ticks the boxes.

Of course as I understand it this isn't your finished product so no doubt it should look a lot different by the end...

But Tim, that's exactly what I'm saying all of these units have a flat actuator. In your phrase "it has nothing to do with the internals, design protection law covers the externals or aesthetics of a product" Theoretically they are the same, just with a few cosmetics added. To a tube being longer to an overlap of the button, it's all the same. The internals is what separates everything apart.
This is your switch and top cap on the Mako

and this is mine

The only thing that is remotely similar to the Mako is the bottom cap is rounded.

Just for clarification, if you have Isaac's permission to post in his forum, then you're fine.

Thank you Angus

I just watched Isaac's video. Wow! I'm not an expert on all mods, but to me that switch is a genius idea...all mechanical, cool. You weren't kidding.

About the name, I realize there is the Silver Bullet line already, but to me this mod looks like a large caliber bullet or like a shell. Although, the prototype is silver while the finished product will not be. If the green, scaley finish is chosen I suggest the name "Turtle Shell". I don't know if that sounds good, but just an idea. lol

Rock on Dillinger! It's a shame that the name Silver bullet is taken. Hmm The Caliber.......Shotgun....you got my gears turning again!

Tim, Other than the bottom cap being rounded and the fact it has a tube. You can't really call out the top cap as copying because most are tapered for specific reasons such as adapter swaps and atomizer spill proof grooves to begin with.

Other minor differences between the two, is my top cap is longer and will have this leak proof method. my bottom cap is obviously completely different externally as internally. The Mako has the option of a grey (not silver colored) or black body with completely brass caps which is not optional.

Here's the part where your going to laugh, my machinist who knows NOTHING about the Mako, foreseen this unit in his mind with a black and Gold dressing.

Somehow i think it would be very hard to design protect the "look" of what is basically a pipe.
No matter how you slice and dice it , it is a pipe.

So ok, Issac, engrave or stamp or even paint your name on it , suddenly the design has changed and "looks" different, but it is still a pipe LOL Change the button on the bottom to a octangle, it looks different but its still a pipe.

It is the switch that is genius, and a design protectable item.

I prefer to deal with mature venders who have self control in public venues, in this case it would seem the younger one is the more mature .

LOLOL The little pistol :) oh boy , no ? oh well hehehe

Haha!

I just had an idea while reading that. If Isaac were to ever release different sizes of this mod, they could be "The Small Caliber" and "The Large Caliber".

IkenVape: Take a Caliber straight to the chest in 2 convenient sizes!

Thats so funny Mini! Val said the same thing! She said "Just make the button into a sunburst and a midnight edition like the crescent moon and call it a day.

Iken, Compliments on the switch design, Just a note from the Puresmoker v3.. use a fairly stiff spring, they used a spring that had too light of tension, and ended up having to come out with a new spring. Just food for thought. Although i would like to stand up and defend Tim, Hes my bud and we work together. I dont know of any of the products that are patented. I know some are working on it. Im just not sure its worth getting into a pissing match. You have your customers who love you and we have ours that love us. There are plenty of people out there that will want what you have or what we have, its all about battery options, vape time and build quality etc.. I say we should all just try to get along.. (this coming from a guy who just got slapped by a noob supplier who "trademarked" the word term Nic-Stick... I had to change all my effing logos etc even though i have been around almost a year longer than this guy.. all because he went and trademarked the name. He wanted me to change my entire website name. I have a lawyer and resolved it without having to change my site name.. but had to take a hyphen out of my advertising etc.. which totally sucks.. all this.. when we should all be sticking together.. not trying to screw eachother over..) Ok.. Done ranting lol.. Have a good night guys and Good luck with your new device. I am now graciously butting out lol
