Haha I'm in Ohio :). They're laws on vaping aren't that strict honestly

Ohio... where currently in Cleveland they have proposed ordinance (Ord. No. 929-15), which would limit the sale of flavored smokeless tobacco products like snus to specialty tobacco shops, has been introduced in the city council AND are ALSO discussing a measure to change the definition of “tobacco” to include e-cigarettes in the upcoming Tobacco 21 ordinance (which would raise the age to legally purchase to age 21)? Although this may not immediately affect the city’s flavor regulation, should it pass, it will be a short step to include vapor products in the future. That Ohio? :blink:

Ohio... where the governor recently tried to pass a tax on eliquid that would have equate to almost $34.00 on a 30ml bottle of eliquid? That Ohio? :?:

I just went by my local smoke shop to pick up a bottle of Tribeca for travel on Monday (they're the only ones who carry it around me). They didn't know the deeming rules even passed, or that Halo was suing the FDA. I asked what their plans were and they pointed to all the tobacco products they otherwise sell such as cigars, and if they have to drop vape stuff, they will still be in business. However, the guy there expressed sympathy for all the real vapes shops that have nothing to fall back on and will likely fold.
Wow they didn't even know. At least they are already a licensed tobacco shop, they should be fine for awhile at least with vape supplies in a tobacco shop :)

I don't understand why businesses that will be impacted by FDA regulations aren't informed. Why isn't there something in place in the government machine to send out such warnings?

Vaping has been on the edge of being restricted/taxed/regulated/banned for every day I've been vaping. I looked in to starting a vape business in the early days, but the long term risks were pretty obvious. Part of owning a business is keeping abreast of your industry, so any vape shop owners who aren't aware of the FDA's game at this late date are negligent business owners and fools.

I suspect most owners know what's coming and have already made their decisions about how long to stay open. It's the ones who are not informing their customers and staff who are truly causing harm for all. Those people who started vaping at such a b&m and rely on them for all their help and information are being set up for a painful surprise.

We can always buy the cellu cotton at beauty supply stores (it's been used for perms forever). The 18360's are also for flashlights, so they should still be buyable.
That leaves the wire, and I'm short on it as I don't build coils... Yet.

So wait, this may sound stupid but maybe I'm not understanding these regs right. I thought your still gonna be able to sell juice and coils and everything else for two more years after August?

I'm confused, too! What, exactly happens on Aug 7? Are taxes kicking in?

You'll be able to continue to buy wire from Temco and others, no problems there.

On Aug 8 all vape products are deeming tobacco products so that means a states laws in selling tobacco kicks in and can include tobacco tax laws. If a vape shop does not comply with their states tobacco laws they could be fined or if they can't get a license they could be forced to close. The states can be the real problem on top of the FDA rules of forcing shops to report all items they sell and applying for aproval for each item which costs thousands to million $$'s. Most cannot afford that and will just close.

The tobacco shops that sell vaping products are the most likely places to continue to carry them over the next two years as they already have a tobacco license and the mechanisms to easily handle new local and state taxation. Sadly ironic.

I just looked up Ohio tobacco selling laws and it is forbidden to buy cigarettes online, now once ecigs are deemed tobacco could thus apply to online sales of vape stuff in Ohio? It could. It is also unlawful for anyone to sell cigarettes in Ohio without a license and a tax stamp, so with vape gear deemed tobacco, Ohio could be in serious trouble Aug 8. Stock up! :)

True! I think High Desert Vapes is licensed as a tobacco seller so they maybe ok, but the taxes tacked on yikes! Talking 40% in NM

Does the statute say " cigarettes " or all " tobacco products " ? If it says cigarettes, how could the ban extend to ecigs ? If it says " tobacco products " it usually refers back to a "definition" within the statute itself.

Here's how Washington State ( where i reside ) defines " tobacco ". No way they can extend ths definition to ecigs without amending the statute.

z) "Tobacco products" means cigars, cheroots, stogies, periques, granulated, plug cut, crimp cut, ready rubbed, and other smoking tobacco, snuff, snuff flour, cavendish, plug and twist tobacco, fine-cut and other chewing tobaccos, shorts, refuse scraps, clippings, cuttings and sweepings of tobacco, and other kinds and forms of tobacco, prepared in such manner as to be suitable for chewing or smoking in a pipe or otherwise, or both for chewing and smoking, and any other product, regardless of form, that contains tobacco and is intended for human consumption or placement in the oral or nasal cavity or absorption into the human body by any other means, but does not include cigarettes as defined in RCW 82.24.010.

and btw that 21 or older to buy law in Cleveland Ohio did pass and included e-cigarettes.

I mean I hate what is happening presently at the federal level, but, the State and Local levels are where it is going seriously hurt us... bans, new governing laws, regulations/restrictions, taxes... even if things lighten up at the Federal level and the grandfather date is changed.

It says cigarettes. There are already ecig laws in Ohio for minors so it depends on what Ohio has in mind for ecigs once deemed tobacco. They already include all tobacco under no under age tobacco sales. The problem is the term e cigarette, as it could be used to include cigarettes and e cigs, no one knows right now how bad it will get in the states, they can basically do what they want. I found info by searching Ohio tobacco seller laws.

This is exactly why a large number of vapers think this was all about just an age requirement.

This is what has worried me most, the states, they can be worse than FDA! LOL
