I don't know how big the Mormon afterlife is? We might not all fit. Not gonna look it up, I gotta do yoga.

You know, the more I research Mormonism, the more I am like "I am so glad I am not a Mormon,."

Also, Mitt Romney is NOT paying enough attention to his afterlife I don't think.

Politicians tend to forget that stuff. They should stop writing as many nasty bills as they do and ask, "Will you know my name.... when I see you in heaven."

Because like I am sure Eric Clapton's kid will, but there will just be SWARMS of angry people WAITING to have a chat with him.

I sort of bet in most afterlives, there is some afterlife review, lets hope Romney has enough dough to buy his way in because seeing him tortured in hell would be well, something, but I bet it is harder to get a person's attention in the middle of a like, steaming sulfur lake.

Well, there’s a few lawsuits out there that could affect the PMTA deadline in May. I thought I’d post the ones I know about. I don’t know if any of them have good chance of winning, but we only need one.

Mississippi federal district court
United States vaping Association & Big Time Vapes vs the FDA
Plaintiffs claim that the whole Tobacco Control Act is unconstitutional, because Congress cannot delegate its own legislative authority to the FDA. The case is based on the doctrine of nondelegation.

D.C. district
Jen Hoban, et al vs the FDA
Three lawsuits filed by small vaping vendors have been consolidated into one. This suit contends that regulations carrying the force of law must be signed by federal employees who have been appointed by the President and confirmed by the Senate. The Deeming Rule was signed by a career civil servant.

Eastern district of Kentucky
Vapor Technology Association and Vapor Stockroom vs the FDA
Motion for preliminary injunction in lawsuit against FDA to demand PMTA rule and appropriate small business deadline. There are two primary goals to the motion and lawsuit: (1) demand that FDA publish the actual proposed Pre-Market Tobacco Application rule (“PMTA Rule”) that industry has been waiting on for 3 years; and (2) establish a deadline that allows companies, particularly small businesses, the chance to comply with the still unwritten PMTA Rule.

Fourth Circuit
Filled by Keller and Heckman
Appeal and motion to Stay the PMTA deadline decision (May 2020)

Also, there is rumor that the FDA plans to appeal the May 2020 PMTA deadline

Does the rumor include anything about why the FDA might want to achieve by appealing the PMTA deadline?

They're not really ready to start processing PMTAs and enforcing regulations. Also, they haven't yet finalized their guidance to companies about what needs to be included in a PMTA. Companies will sue the FDA for not giving them enough time to prepare their PMTAs.

Also, by next May this impeachment stuff will be behind us, and we'll be in an election year. I don't think it'll be a good time for Trump to shut down thousands of businesses and put thousands of people out of work. We Vape; We Vote

Yeah, but I think we're supposed to vote 'em all out until we find some that work....

Kinda hard to do that by May, though. ;)
Vote out the guy who is anti vaping and replace him with a new guy who is anti vaping.

Meet the new boss. Same as the old boss. We will get fooled again.

TBH, I don’t know who else I’d vote for; maybe I won’t vote for anybody.

Greg Conley talked to Trump about the PMTA deadline during the big meeting last month, so he knows about it. I imagine Paul Blair will start putting pressure on Trump again soon. Maybe we need to light up the Whitehouse switchboards again and even have another rally in Washington.

Maybe get an education how things work. Not everything that happens in D.C. is the president's doing. The PMTA has nothing to do with Trump and was started long before him. Quit listening to fake news and take the time to educate yourself with real FACTS.

Maybe I'm Mis-Reading what you are saying?

But Trump isn't Shutting anyone down Deeming-wise. That rock started to roll down the Hill in 2016.

And I'm Not Sure how well the current FDA could do anything regarding a Drop Dead Date? Seeing that they were the Ones who pushed for the current Date in court

Anything the FDA does during Trumps term, he's going to get the blame for. I guess what I was trying to say is if he wants them to appeal the lawsuit that moved up the deadline date, they'll try to do it.

I don't see the FDA as having "pushed" for this. The APA et al sued with the claim that the FDA didn't follow proper procedures when they kicked the deadline from 2018 to 2022/2021. The court agreed and demanded proposed remedies from both sides. The APA et al asked for something absurd, like 30 days. The FDA asked for the maximum that they thought the court might accept, 10 months, and the court did accept it. I don't think it was ever the desire of this administration's FDA to pull the deadline forward, and entrenched bureaucracies do not take kindly to having their decisions challenged.
