Here is the Question I would be Asking.

Where does the Alcohol and tobacco Tax and Trade Bureau gets its Authority from?

If it's authority comes from Laws and Definitions that are defined under an Internal Revenue Code, doesn't an Internal Revenue Code have to include e-Cigarettes/e-liquids in some way for the TTB to have authority over them?

Damn... Where's a Governmental Lawyer when you need one?

It wasn't the the part about the collection of taxes that caught my attention. I was (and I think still am) trying to find the agency with authority over the manufacturing of alcohol. Who checks for compliance? Alcohol isn't a food or a drug. It appears to be in its own category.

Is there a way nicotine could someday be severed from combustible tobacco?

Nope. I appear to have gotten it right the first time.

From the ATF website:

ATF's Alcohol and Tobacco Enforcement Programs purpose is to target, identify, and dismantle criminal enterprises with ties to violent crime, that traffic illicit liquor or contraband tobacco in interstate commerce; seize and deny their access to assets and funds; and prevent their encroachment into the legitimate alcohol or tobacco industry.

As of January 24, 2003, The U.S. Department of the Treasury, Alcohol and Tobacco Tax & Trade Bureau (TTB), is responsible for all inquiries in regards to the:


    • Manufacture, wholesale and importation of alcohol and tobacco;
    • Regulating the alcohol and tobacco industries and Special Occupational TAX (SOT); and
    • Collection of the Alcohol, Tobacco, Firearms and Ammunition Excise Taxes imposed on manufactures and importers of these products.

What is Alcohol and Tobacco Diversion?

It is the trafficking of alcohol and tobacco products in avoidance of Federal, State or foreign taxes or in violation of Federal, State or foreign law.


So, umm, I think, umm, under the authority of the Dept. of the Treasury, TTB collects taxes and under the authority of the Dept. of Justice, ATF (basically) enforces the collection of taxes. How can the FDA go forward with controlling the vaping market without reconciling the regulations of other agencies?

I know a couple of years ago, a corner store got busted by the atf,because they were sell cigs that came out of an city ( less tax ) and selling them in the city with higher tax, and with the cigs not having the correct tax stamp owner got 5 yrs

That's a big business. Somewhere on here I linked to an article about a guy who buys cigarettes in WV, then sells them out of a van in NYC. He was making lots of money.

I was always lead to believe that they were tax collectors with badges and guns

Eliot Ness worked for the U.S. Treasury Department. The Dept. of ATF was created later.

All kidding aside in Alabama you can open a religious day care and not be licensed or inspected. (Fire department)will look at the building, but other than that nothing!

If FDA ever gets control, Potato Farmers will need an Alcohol sub-manufacturer license.:facepalm:
