media outlets try to outdo each other on for the next cool phrase. Any guesses what the next one will be?

Won't be the next one, but "Wild West" will make a comeback on Aug 9, 2018. And it will make what they called the "Wild West" look tame in comparison.

They'll likely recycle 'nicotine is poison' - worked well the first time.

I don't understand why a lot of "open system" gear couldn't under "dual use" (like they way the head shops used to get away with it - not the current "dual use" catch phrase).

In other news...

First it was the "Wild West," then it was "Flavors," then it was "Gateway" and now it's "Dual Use." I realize everything except Wild West still appears daily, but the blurbs and sound bites seem to be coming faster as media outlets try to outdo each other on for the next cool phrase. Any guesses what the next one will be?
Perhaps I'm being optimistic but how about: to counter a billion lives, FDA uses a billion lies; cohorts found among congress and media outlets as sound bites replace science.

Yes too long for a catch phrase. :)

Even if corporations control the media, writers still write. Someone somewhere will come up with a new catch phrase then you will see it everywhere. "Nicotine is Poison" is so May.

You are right; writers do write. Perhaps we should turn them on to the real juice of this story, which is not "save the children" or "dangers of teen ecig use" but rather; unchecked, baseless and reckless government.

Forgive me for not knowing who that is but in my mind there is no greater story for the press than government corruption: see water gate, Iran contra, Monica Lewinski etc. the fact that multiple branches of government would willfully miss represent facts to protect revenue over citizens is THE story.

I'm working on it. I'm looking for writers to reach out to who might be looking to make a name for themselves. Despite the sentiment than investigative journalism is dead, there are still a good number who would like to be the next Bob Woodward or Carl Bernstein.

In a 24/7 news cycle: it only takes one to light that day. And yes I do believe that. One well placed investigative report would jerk the spotlight. Not saying it would be easy: I'm saying it's possible.

That is exactly what I have been thinking. There are always those who are willing to go rogue for what is true and right.

It's getting ugly out there in Vape land. I always worried it would be the states that put the hammer down first to get as much revenue as possible while they still can.

It's not just revenue. There is a lot to fear from local governments. People seem to forget that the city of San Raphael, CA passed an law that smoking was banned in any structure that had a common wall, due to second-hand smoke. That means one can't smoke in the million dollar condo they own. It's enforced too.

The media hated Nixon and that's why Woodward & Bernstein got traction. The media is aligned with tobacco control. The story will never see the light of day. And believe me, I hope I'm wrong.

In my second letter to Sen. Johnson, that I sent on June 1st, I told him that I had a feeling the FDA would likely respond with a copy of the Final Regulatory Impact Analysis/Final Regulatory Flexibility Analysis/Unfunded Mandates Reform Act Analysis (FRIA). It is a very troubling document, even more confusing and contradictory than the Final Deeming Rule.

It's pretty astounding that in the introduction the FDA states, "The Regulatory Flexibility Act requires us to analyze regulatory options that would minimize any significant impact of a rule on small entities. We find that the final rule will have a significant economic impact on a substantial number of small entities."

Then it goes on for 156 pages saying we don't know, the market is growing too fast to have accurate info, blah, blah, blah.

I wrote a long message to Sen. Johnson advising that if the FDA sent the FRIA, claiming it somehow answered his questions, to read it very carefully. I then quoted several passages that were of particular concern.

I'm not holding my breath that Sen. Johnson will have a significant impact on the FDA, but I appreciate his questions and common sense. I welcome anything that will get our perspective attention.

So.......... How did they get past this?
If, without the final rule, new products would pose substantially greater health risks than those already on the market, the premarket requirements made effective by this final rule would keep such products from appearing on the market and worsening the health effects of tobacco product use.

But what if the narrative changed from "tobacco control" to "citizen control"?
