Wow he is more powerful than Obama.
Can He or the DHS do it?
Is he a senator or an executive in DHS?
all I had seen so far is letters requesting and no actual subpoena. I could be wrong though .

I think it would take the entire committee he is chair of to endorse a subpoena.

My understanding is he said a couple weeks ago that it was highly unlikely he would issue a subpoena. He said, instead, their lack of response would serve as ammo in a lawsuit.

No. Well I've checked all today because yesterday was another 'deadline' for the 2nd letter he sent them with no reply. He originally said (basically) he'd prompt them with a few letters first. Whether another letter with another deadline comes or the subpoena, no one knows but him probably. The letter prompts gives him some credibility, imo to make the case for a subpoena. Esp. when they refuse to reply. That's my take anyway.

The FDA is not required to answer Senator Johnson and I think he is aware of this.
Let's see if he will send them a Congressional Subpoena which is within his power to do so. I believe that has been his intent.

OK Senator, the ball is now firmly in your hands and let's see what you do with it now ;)

With a little more thought, this is a very interesting situation. One has to ask why the FDA would not reply. An obvious possibility is they don't want to expose their weak legal standing to enforce their regulations. When being silent is the better of two choices, well, let's just say their silence is deafening. People who plead the 5th usually have something to hide.

I suspect he will lose his chair position without the majority backing in the full committee if he sends a subpoena on his own.
Posturing I think.
