The loophole is that they are not under the FDA's jurastinction. The FDA has no authority over any foreign company, only on the US marketplace, so the importer or distributor would be the ones to catch any heat.

Makes sense. I wonder how people would feel if shot glasses and straws were labeled alcohol, like the tanks and coils are tobacco.

Do they forfeit the money made from it? ( if they are caught )

They'll possibly lose their investment and will likely have to pay a hefty fine if prosecuted

Don't have to, Duane. I posted about the FDA's raid on both the Amish and the Rawesome Club
right in this very forum a couple of years ago..As a matter of fact my post was a point of contention because somebody (no longer a member here) didn't believe federal agencies have SWAT Teams.

I've read the articles, seen the youtube videos, ETC. There are entirely too many federal agencies with SWAT Teams for my taste...
However, it still takes somebody, usually a competitor or disgruntled former employee snitching.
Of course once the feds recognize a money making venue using asset forfeiture they will act on their own

Tobacco companies is an example of huge wealth within very few hands, the vaping revolution was a grass roots small entity up shoot, spread out, disorganized, many small players. Now the market is naturally evolving with bigger entities and stronger players, but still rather spread out. Ripe for the pickin's of big money, government corruption, and corporate buyouts.

Probably Rawsome but there have been a few other co-ops that have been raided by the FDA.
Our milk must be pasteurized.. Why?
Because co-op's products don't have SKUs and the Feds have no way of figuring how much money in taxes to levy on them..Don't believe the crap about how the Feds are protecting our health.
They don't give a hoot about our health..money talks.

All because I made a funny about Robin..The funny part is that I've been known to send Robin (virtual) flowers
