At first read the filing appears to be no more than tabloid journalism disguised as a legal document.
The FDA's arguments as presented are nothing more than a rehash of the same thoroughly debunked ANTZ propaganda we've been seeing all along. Now the FDA will have to defend their claims under cross examination.
Further, the oh-so-graphically described exploding device injuries reek of desperation.
Fortunately, most judges can see right through this sort of 'If you can't dazzle them with brilliance, baffle them with BS.' nonsense.
The oral arguments should be very entertaining to say the least.
Will the judge know or discover the bogus nature of these "studies" and other propaganda that this response seems to rely on as its defense though?

I need some comfort food...

The plaintiffs' lawyers are there to make sure the judge does indeed "see through" those "studies".

There are 9 million vapers in the US. How many have experienced an ecig exploding? Less than 1/10th of 1% would be my guess. But we need to regulate them out of existence according to the FDA. Nonsense!
How many injuries caused by cars? By phones?

Further, the problems were mostly operator error. Stupid people (or u educated) will do stupid things, and no matter how hard you hit them with a hammer, you just can't pound any sense into them...

That would be about 9,000 people that have experienced an exploding ecig?
That sounds wayyyy to high.

Maybe a few hundred or so?

@Wing, there is a thing I think called the Vape Case which is a Lion Battery, switch, and a 510 that can fit on several cell phones (you used to order for your model of phone), the later ones even were VV/VW,lol AND could put a charge on your phone and could be agued yes your cell phone is now a tobacco product.

Your phone is already a tobacco product because of its software.

I don't think the amp rating on most cell phone batteries is gonna make the cut...

In the FDA response they list 25 injuries of exploding batteries.

The U.S. Fire Administration found 25 media reports of e-cigarette explosions or fires between 2009 and 2014, and concluded that the shape of e-cigarettes makes them more likely to shoot off like “flaming rockets” when a battery fails.

And no deaths? Safer than riding an escalator, or even an elevator. Good thing they don't regulate those too or we would only be able to use the stairs.

One one death due to nicotine poisoning for a 5 year old, that we all heard about.
