What should be Alarming is when Laws are Vague enough, or when New Legislation hasn't kept pace with Markets/Society that Judges need to Extend as much Judicial Deference as many Judges feel that Should/Have to/Can.

I think it would be Interesting to Step Back for a Moment and consider How Viable a prescription e-Cigarette would be as a Drug Deliver System (DDS) while Co-Existing in parallel to e-Cigarettes as tobacco Products in the tobacco Product Market?

Because is that what Our FDA Commissionaire is advocating as a Possibility?
Or is Scott attempting to Open a Legislative door which would provide a Solution to His Epidemic?
Or, perhaps, something else?

Laws today are intentionally vague to allow the bureaucracy to "interpret " congressional intent. Congress is quite happy to allow the bureaucracy to impose the rules as they see fit.

I suspected this was coming about a month ago when a media Doctor wrote an opinion piece in the Wall Street Journal about a month ago. While admitting vaping is an alternative to smoking, we must protect the children. If you need a vape, "I will write a prescription for you". BP will then create some abomination.
See, we heard your concerns.

Now, we have an opportunity to build on these NRTs, with novel products that may provide an opportunity to save even more lives by empowering adults to safely and effectively quit smoking.

Yo, Scott, those novel products already exist. They were invented in 2003, hit the market 10-12 years ago, and have been improved and refined ever since.
Maybe he doesn't know what "novel" means.

Interesting. Any link to the original source material up yet? This is one of those the devil in the statistics papers. Could be good, could end up easily twisted, which is why diving in may, or may not, be a necessary part of it. The daily e cigarette use over time among former smokers looks pretty significant though.

I'm still stuck on the sensors, and the teacher, LOL. That money would better be spent on equipping her with Quaker type outfits. It's a fair bet the male students in that class (AND THE LESBIANS!) are not learning ONE thing. LOL

I just got back from picking up a prescription at CVS. They had 8 people behind the counter and they were all swamped.
Sometimes I think I'm the only one in the country over 55 who doesn't take prescription drugs on a daily basis.

I didn't, until my thyroid had to be essentially "killed" (had to swallow a radioactive iodine capsule), when it was making enough "stuff" for me and 4 others. Since then I take a Synthroid tablet 6 days a week.
