FDA Still Detaining & Holding E Cig Shipments

I had a similar situation back in late September. If I remember, correctly, the shipping carrier, TNT, said the FDA seized my shipment (LAX, eGo batteries and cartos. $500.00 + or so) and there was nothing they could do. They, TNT, were well versed on the subject and advised me to contact the FDA. I contacted the FDA Ombudsman and was told any e cigarette items from China were mandated to be seized. When I questioned the court ruling FDA was to stop seizures, I was told that was only for N-Joy and I would have had to be part of the suit for my shipment to be released.
Bottom line, it was too expensive to return, so the FDA put it in their pile of confiscated stuff & My wife and I were out of what we hoped to be a years + worth of vaping hardware supplies.

Unbelievable... apparently now us vapers are public enemy #1 while other substances travel straight up I-35 from Mexico daily.

    I currently Have a shipment of e-cigs being held by DHL well really the FDA at LAX. I have never had a package held for so long and I have been getting shipment for about 2 years. It has now been over 2 weeks. After calling DHL everyday I finally had a import supervisor tell me that they is nothing I can do and They can't do anything either. It sounds like I will get a letter in the mail or that DHL will get a letter. I'm not really sure anymore.

    I'm glad I pretty much put all my money into this order!


    I believe I wes told that they have about 100 orders being held just at LAX, It seems this has started because of the last court decision.

    when dealing with elected officials, probably best to find a few who are already on your side, otherwise you are likely to get only a form letter for your efforts.

    I believe the entire Senate is bought and paid for, so I have no reccos on that.

    With all the mods being manufactured here already (or DIY'd), thus reducing any real dependence on Chinese-made batteries, this is all the more reason why we desperately need American-made atomizers/cartomizers...ASAP.

    You would think with all the techies in this country, they could make a killing by making these. I would rather pay a little more for them here, than to give China my money.

    My opinion of the FDA: They can kiss my rebel :censored:. Also, they all need to be fired, put on a slow boat to China, and made to work in an ecig factory licking the floors clean.

    What really pisses me off is that OUR TAX MONEY pays for their bull:censored:!!!

    Thanks for letting me rant....I feel "slightly" better.

    I received a shipment of carto's on 1-14-11 from China. Came through without a glitch. I have 2 more shipments from healthcabin that I'm waiting on. One's on a plain and the other is still in China. I'm hoping they get here and in my hands without the F-stinking-D-rotten-A getting ahold of them.

    I emailed Rush Limbaugh. Didn't bother with my Senators because Maryland is so Blue it looks like a Smurf and they just won't bother to listen (Steny Hoyer ring a bell to anyone??). I do have a newly-elected Republican Congressman for my District, so I will email him.

    If you'd like to email Rush...who might be sympathetic because after all he IS an e-cig vaper, here's his email addy:

    He has another "private" email addy for the members of his site, but I'm not one, so I can't pass it on. LOL Perhaps the topic will catch the attention of his assistants, however...so make sure to mention FDA seizing e-cigs in the subject line!!

    What do they call that then? 'Justice for sale, ask your lawyer for details'?
    An e-cig is an e-cig regardless of who distributes it. e-cigs are either legal to import or they are not, surely? :facepalm:
    How can a high court judgement only apply to the one who brought the suit? What happened to a little thing called 'precedent'?

    In common law legal systems, a precedent or authority is a legal case establishing a principle or rule that a court or other judicial body may utilize when deciding subsequent cases with similar issues or facts

    So why is it that the FDA can ignore precident and continue like nothing happened?

    i read this entire thread, e-mailed 3 different state officials here in nevada. please bear with my ignorance, what does this ultimately mean? are all the supplies going to dry up and our e-cig society vanish? i know this sounds extreme, but isn't this what the fda is shooting for? is this e-cig craze big enough that it can stand on it's own here in the states, without the supplies from china?
     
    Sent this out this morning, to Limbaugh, after hearing the news.
    I think it's going to take the medias intervention, first and foremost, and then we go after the others.
    Short and simple gets it read. Get too wordy and the intent gets lost.
    After all, these investigative reporters have better access to sources than even ECF.

    Again the FDA is overstepping on the E-cig front. Shipments are "again" being held from China.
    I know you are likely getting a flurry of e-mails on the subject from us over at e-cigarette-forum.

    Many of us have given up (or are extremely frustrated) trying to contact Congress members OR the FDA, and are resorting to media. Thus far, You and Stossel have sorta been the "lone wolves" calling for common sense.
    There are a few others but it seems minimal in common sense and numbers.

    PRAYERS ARE THAT YOU WOULD RAISE A RUCKUS ON THIS SUBJECT AGAIN !

    A killing? No. Manufacturing is pretty much dead in this country due to the EPA, IRS, FDA, insert three letter gov't agency here plus the unions. You'd pay at least double the cost you pay right now for the same thing.
