I expect the FDA to abide by the rules and not to be beholden to anyone especially big pharma.
Apparently that isn't how we play ball in the US.
As far as the picture goes,we aren't even close to becoming a socialist country.
Despite all the bs, most people do not turn out to voice their opinions
when their civil liberties are threatened.
We just whine about it in posts mostly.
Please don't infer I mean anything except what I've stated here.

I agree with you and that's exactly why i'm writing my letters tonight. And i expect everyone in this community to do the exact same. Stop JUST complaining about it and make a impact. alot of us have been sitting on the sidelines moaning and groaning. Well, it's not a BIG BIG thing but writing your local representatives is a big big step up from sitting here and mooping about it.

I'm not an attorney, but it has been my understanding that Judge Leon's ruling (prohibiting the FDA from seizing e-cigarettes while the court case proceeds), which was recently upheld by the DC Court of Appeals, only applied to Smoking Everywhere and njoy products.

Any other e-cigarette company that wants similar protection by the court (from the FDA) would need to petition to intervene in the case.

But by seizing products of other e-cigarette companies, the FDA is inviting other e-cigarette companies to intervene, and is making it easier for us to encourage Republican House committee chairs and members to investigate the FDA.

when dealing with elected officials, probably best to find a few who are already on your side, otherwise you are likely to get only a form letter for your efforts.

The battery-operated device, known as an electronic cigarette, looks like a normal cigarette, but contains no tobacco and instead of smoke emits a nicotine vapor when the user inhales. Reps. Cliff Stearns (R-Fla.), Duncan Hunter (R-Calif.) and Collin Peterson (D-Minn.) have all been spotted using the device on Capitol Hill.

Chicago and Los Angeles are the only two places I am aware of at this time were it is being done. Think it may depend on who is working for whom as to what is grabbed.

I think I read on one of these threads that it was happening at JFK in NYC too.

I can tell you that the information that I was told was that this is at all Custom Ports. I'm sure it just depends on luck to whether things get through or not. How they are packaged etc. I just wanted people to be aware that if you order be sure you are ready to lose that money. I know if this package gets sent back it's not going to be easy to get a refund of any kind. I thought I would get a good price on CE2's and then be able to give some of them to several people I wanted to try to get to quit.

The lesson I have learned is that I will buy from a U.S. Company. They are taking this risk every time they order. The extra money I pay is small compensation for the risk they are taking to supply us with the e cig.

This is exactly the way I understand it as well.

I the claims made by VapnNow are correct, and if VapnNow is willing to reveal his/her name, I'd be pleased to contact several reporters to try generating a news story (about the FDA continuing to seize e-cigarette shipments).

I'm guessing then that you would need to get an injunction to prohibit the FDA from seizing everyone else's goods.
It is really unfortunate the all the suppliers didn't try and join in as a group to fight the FDA.
I don't know if anyone else wanted to or were invited to align with Njoy but perhaps if some had taken the initiative this may not be happening still?
Mind you I am not faulting any of the other vendors but surely this was foreseeable?
Given the FDA's .... proclivities.

IMO the FDA is trying to financially devastate as many vendors/suppliers as possible while they can. When a small company has thousands of dollars worth of their inventory seized, they will eventually have to close up shop.

This is how the FDA is wasting YOUR tax dollars! Endless appeals and posturing, and their pockets are bottomless.

I had a similar situation back in late September. If I remember, correctly, the shipping carrier, TNT, said the FDA seized my shipment (LAX, eGo batteries and cartos. $500.00 + or so) and there was nothing they could do. They, TNT, were well versed on the subject and advised me to contact the FDA. I contacted the FDA Ombudsman and was told any e cigarette items from China were mandated to be seized. When I questioned the court ruling FDA was to stop seizures, I was told that was only for N-Joy and I would have had to be part of the suit for my shipment to be released.
Bottom line, it was too expensive to return, so the FDA put it in their pile of confiscated stuff & My wife and I were out of what we hoped to be a years + worth of vaping hardware supplies.
